SOCIAL ACCOUNTABILITY REQUIREMENTS1.) 童工準(zhǔn)則:1.1 公司不可招用童工或支持招用童工的行為。1.2 公司應(yīng)該建立、記錄、維持有關(guān)拯救童工的政策和程序,和有效的傳達(dá)這些政策和程序給員工和其它利益團(tuán)體,并且應(yīng)該提供足夠的支持來促使童工接受學(xué)校教育,直到他們超過兒童年齡為止。1.3 公司應(yīng)該建立、記錄、維持有關(guān)推廣童工教育和未成年工教育的政策和程序,并且有效的傳達(dá)這些政策和程序給員工和其它利益團(tuán)體,這些政策程序規(guī)定下的兒童必須符合國際勞工組織第146條條款建議,未成年則屬于當(dāng)?shù)貜?qiáng)制教育法律規(guī)定下的年齡或正在求學(xué)當(dāng)中。政策和程序應(yīng)該包括具體措施來確保在上課時(shí)間內(nèi)不招用童工或未成年工,而且童工和未成年工的每日交通(來回工作地點(diǎn)和學(xué)校)、上單和工作時(shí)間加起來不得超過十小時(shí)。1.4 公司不可置兒童或未成年工人于工作環(huán)境內(nèi)外任何具危險(xiǎn)性、不安全性或不健康的情況之下。1. CHILD LABOR Criteria:1.1 The company shall not engage in or support the use of child labor as defined above;1.2 The company shall establish, document, maintain, and effectively communicate to personnel and other interested parties policies and procedures for remediation of children found to be working in situations which fit the definition of child labour above, and shall provide adequate support to enable such children to attend and remain in school until no longer a child as defined above.1.3 The company shall establish, document, maintain, and effectively communicate to personnel and other interested parties policies and procedures for promotion of education for children covered under ILO Recommendation 146 and young workers who are subject to local compulsory education laws or are attending school, including means to ensure that no such child or young worker is employed during school hours and that combined hours of daily transportation (to and from work and school), school, and work time does not exceed 10 hours a day.1.4 The company shall not expose children or young workers to situations in or outside of the workplace that are hazardous, unsafe, or unhealthy.2.) 強(qiáng)迫性勞動準(zhǔn)則:2.1 公司不可有(或支持)強(qiáng)迫性勞動的行為,也不可要求受聘的員工存放押金或身份證于公司。2. FORCED LABOUR Criterion:2.1 the company shall not engage in or support the use of forced labour, nor shall personnel be required to lodge deposits or identity papers upon commencing employment with the company.3.) 健康與安全準(zhǔn)則:3.1 公司應(yīng)該考慮到工業(yè)中普遍認(rèn)知的危險(xiǎn)和任何特定的危險(xiǎn)。而提供一個(gè)健康與安全的工作環(huán)境,并且采取適當(dāng)?shù)牟襟E,來防范因工作而產(chǎn)生的跟工作有關(guān)的或工作當(dāng)中發(fā)生的意外和傷害,在合理實(shí)施范圍內(nèi),盡量減少工作環(huán)境中固有的危險(xiǎn)原因。3.2 公司應(yīng)該指定一個(gè)高階管理代表,來負(fù)責(zé)所有員工的健康與安全,并且負(fù)責(zé)實(shí)施本標(biāo)準(zhǔn)中有關(guān)健康與安全的規(guī)定。3.3 公司應(yīng)該確保所有的員工都接受定期的和有記錄的健康與安全訓(xùn)練,并為新進(jìn)和調(diào)職的員工重復(fù)舉辦這項(xiàng)訓(xùn)練。3.4 公司應(yīng)該建立系統(tǒng)檢查、防范可能危害員工健康與安全的隱患或采取相應(yīng)對策。3.5 公司應(yīng)該提供所員工干凈的衛(wèi)生問體,可飲用的水,在適當(dāng)?shù)那闆r下,并提供員工儲藏食物的衛(wèi)生設(shè)備。3.6 如果公司提供員工宿舍,應(yīng)該確保宿舍設(shè)備干凈、安全,并能滿足員工的基本需求。3. HEALTH AND SAFETY Criteria:3.1 The company, bearing in mind the prevailing knowledge of the industry and of any specific hazards, shall provide a safe and healthy working environment and shall take adequate steps to prevent accidents and injury to health arising out of, associated with or occurring in the course of work, by minimizing, so far as is reasonably practicable, the causes of hazards inherent the working environment;3.2 The company shall appoint a senior management representative responsible for the health and safety of all personnel, and accountable for the implementation of the Health and Safety elements of this standard;3.3 The company shall ensure that all personnel receive regular and recorded health and safety training, and that such training is repeated for new and reassigned personnel;3.4 The company shall establish systems to detect, avoid or respond to potential threats to the health and safety of all personnel;3.5 The company shall provide, for use by all personnel, clean bathrooms, access to potable water, and, if appropriate, sanitary facilities for food storage;3.6 The company shall ensure that, if provided for personnel, dormitory facilities are clean, safe, and meet the basic needs of the personnel.4.) 組織工會的自由與集體談判的權(quán)利準(zhǔn)則:4.1 公司應(yīng)該尊重所有員工自由成立和參加工會,以及集體談判的權(quán)利。4.2 當(dāng)自由組織工會和集體談判的權(quán)利受到法律限制的時(shí)候,公司應(yīng)該協(xié)助員工采用類似的方法來達(dá)到獨(dú)立和自由的聯(lián)合和談判的目的。4.3 公司應(yīng)該確保工會代表不受歧視,并且在工作環(huán)境中能夠接觸工會的會員。4. FREEDOM OF ASSOCIATION & RIGHT TO COLLECTVE BARGAINING Criteria:4.1 The company shall respect the right of all personnel to form and join trade unions of their choice and to bargain collectively;4.2 The company shall, in those situations in which the right to freedom of association and collective bargaining are restricted under law, facilitate parallel means of independent and free association and bargaining for all such personnel;4.3 The company shall ensure that representatives of such personnel are not the subject of discrimination and that such representatives have access to their members in the workplace,5.) 歧視準(zhǔn)則:5.1 公司在聘用、報(bào)酬、訓(xùn)練機(jī)會、升級、解聘或退休等事務(wù)上,不可從事或支持任何基于種族、社會階級、國籍、宗教、殘疾、性別、性別取向、工會會員資格或政治關(guān)系的歧視行為。5.2 公司不可干涉員工遵奉涉及種族、社會階級、國籍、宗教、殘疾、性別、性別取向和工會的信條、規(guī)范或要求的權(quán)利。5.3 公司不可允許帶有強(qiáng)迫性、威脅性、凌辱性或剝削性的性侵犯行為,包括姿勢、語言和實(shí)際的接觸。5. DISCRIMINATION Criteria:5.1 The company shall not engage in or support discrimination in hiring, compensation, access to training, promotion, termination or retirement based on race, caste, national origin, religion, disability, gender, sexual orientation, union membership, or political affiliation;5.2 The company shall not interfere with the exercise of the rights of personnel to observe tenets or practices, or to meet needs relating to race, caste, national origin, religion, disability, gender, sexual orientation, union membership, or political affiliation.5.3 The company shall not allow behaviour, including gestures, language and physical contact, that is sexually coercive, threatening, abusive or exploitative.6.) 懲罰性措施準(zhǔn)則:6.1 公司不可從事或支持肉體上的懲罰、心理或生理上的壓制,和語言上的凌辱。6. DISCIPLINARY PRACTICES Criterion:6.1 The company shall not engage in or support the use of corporal punishment, mental or physical coercion, and verbal abuse.7.) 工作時(shí)間準(zhǔn)則:7.1 公司應(yīng)該遵守適用法律規(guī)定下的合乎產(chǎn)業(yè)標(biāo)準(zhǔn)的工作時(shí)問:在任何情況下,不可經(jīng)常要求員工一個(gè)星期內(nèi)的工作時(shí)間超過四十八小時(shí),并且應(yīng)該確保員工每七天之內(nèi)至少有一天的休息時(shí)間。7.2 公司應(yīng)該確保每一員工的加班加點(diǎn)時(shí)間工作(一星期超過四十八小時(shí))一星期不得超過十二個(gè)小時(shí)。除非在特殊和短期的業(yè)務(wù)情形之下,公司不應(yīng)要求員工加班加點(diǎn),并且應(yīng)該無例外地對加班加點(diǎn)支付出加班津貼。7. WORKING HQURS Criteria:7.1 The company shall comply with applicable laws and industry standards on working hours; in any event, personnel shall not, on a regular basis, be required to work in excess of 48 hours per week and shall be provided with at least one day off for every seven day period.7.2 The company shall ensure that overtime work (more than 48 hours per week) does not exceed 12 hours per employee per week, is not demanded other than in exceptional and short-term business circumstances, and is always remunerated at a premium rate.8.) 工資報(bào)酬準(zhǔn)則:8.1 公司應(yīng)該確保所支付的標(biāo)準(zhǔn)工作星期的工資至少能夠達(dá)到法律或產(chǎn)業(yè)規(guī)定的最低工資標(biāo)準(zhǔn),而且它支付的工資應(yīng)該總是足以滿足員工的基本需求,和提供一些可隨意支配的收入。8.2 公司應(yīng)該確保不會為了懲罰的目的而扣減工資,并且確保定期和清楚地列明工資和福利的構(gòu)成成份;公司也應(yīng)該確保它所支付的工資和福利完全符合所有適用的法律,而且報(bào)酬支付的形式,無論是現(xiàn)金或支票,都應(yīng)方便工人;8.3 公司不可采用純勞務(wù)性質(zhì)的合約安排和虛假的日見習(xí)期辦法,來逃避勞工法和社會安全法規(guī)中的公司對員工應(yīng)當(dāng)?shù)牧x務(wù)。8. COMPENSATION Criteria:8.1 The company shall ensure that wages paid for a standard working week shall meet at least legal or industry minimum standards and shall always be sufficient to meet basic needs of personnel and to provide some discretionary income;8.2 The company shall ensure that deductions from wages are not made for disciplinary purposes, and shall ensure that wage and benefits composition are detailed clearly and regularly for workers; the company shall also ensure that wages and benefits are rendered in full compliance with all applicable laws and that compensation is rendered either in cash or check form, in a manner convenient to workers;8.3 The company shall ensure that labour-only contracting arrangements and false apprenticeship schemes are not undertaken in an effort to avoid fulfilling its obligations to personnel under applicable laws pertaining to labor and social security legislation and regulations.9.) 管理系統(tǒng)準(zhǔn)則:9. MANAGEMENT SYSTEMS Criteria: 政策9.1 管理高層應(yīng)該制定有關(guān)社會責(zé)任和勞動條件的公司政策,以確保這個(gè)政策:a.) 包括對符合本標(biāo)準(zhǔn)內(nèi)所規(guī)定的承諾;b.) 包括對遵守國家和其它適用的法律、公司簽署的其它規(guī)章,和對尊重國際協(xié)議和其解釋 (如第二部份所列) 的承諾;c.) 包含對不斷改善的承諾;d.) 有效的記錄、實(shí)施、維持和傳達(dá)這個(gè)政策,并且采用一種容易理解的形式,供所有員工隨時(shí)取閱,所有員工要包括董事、決策階層、經(jīng)理、監(jiān)督和非管理人員,不論是直接雇用包括董事、決策階層、經(jīng)理、監(jiān)督和非管理人員,還是直接雇用,合約性質(zhì)或用其它方式代表公司的人;e.) 對公眾公開Policy9.1 Top management shall define the companys policy for social accountability and labour conditions to ensure that it:a) includes a commitment to conform to all requirements of this standard;b) includes a commitment to comply with national and other applicable law, other requirements to which the company subscribes and to respect the international instruments and their interpretation(as listed in Section II);c) includes a commitment to continual improvement;d) is effectively documented, implemented, maintained, communicated and is accessible in a comprehensible form to all personnel, including, directors, executives, management, supervisors, and staff, whether directly employed, contracted or otherwise representing the company;e) is publicly available, 管理審查9.2 管理高層應(yīng)該定期評審公司的政策、程序和表現(xiàn)結(jié)果,本標(biāo)準(zhǔn)和公司簽署的其它規(guī)章,判定其是否充分;合適和持續(xù)有效。在必要的時(shí)候,應(yīng)該做系統(tǒng)的修正和改進(jìn)。Management Review9.2 Top management shall periodically review the adequacy, suitability, and continuing effectiveness of the companys policy, procedures and performance results vis a vis the requirements of this standard and other requirements to which the company subscribes. System amendments and improvements shall be implemented where appropriate. 公司代表9.3 公司應(yīng)該指定一個(gè)高層管理代表,不論他在公司是否擔(dān)負(fù)其它任務(wù),來負(fù)責(zé)確保公司達(dá)到本標(biāo)準(zhǔn)中的規(guī)定。9.4 公司應(yīng)該協(xié)助非管理階層的員工從所屬部門中選出代表,以便充分與高層管理代表就本標(biāo)準(zhǔn)規(guī)定的事項(xiàng)進(jìn)行溝通。Company Representatives9.3 The company shall appoint a senior management representative who, irrespective of other responsibilities, shall ensure that the requirements of this standard are met;9.4 The company shall provide for non-management personnel to choose a representative from their own group to facilitate communication with senior management on matters related to this standard. 計(jì)畫與實(shí)施9.5 公司應(yīng)該確保組織中的每一個(gè)層次皆能了解和實(shí)施本標(biāo)準(zhǔn)的規(guī)定;它可以采用的方法應(yīng)該包括但不限于下列各項(xiàng):a.) 明確地界定作用,責(zé)任和職權(quán);b.) 在招用之初,訓(xùn)練新進(jìn)或臨時(shí)的員工;c.) 為現(xiàn)有員工提供定期訓(xùn)練和繼續(xù)教育計(jì)畫;d.) 持續(xù)監(jiān)督相關(guān)的活動和成效,證明所實(shí)施的系統(tǒng)是否有效地達(dá)到公司政策和本標(biāo)準(zhǔn)的規(guī)定。Planning and implementation9.5 The company shall ensure that the requirements of this standard are understood and implemented at all levels of the organization; methods shall include, but are not limited to:a) clear definition of roles, responsibilities and authority;b) training of new and/or temporary employees upon hiring;c) periodic training and awareness programs for existing employees;d) continuous monitoring of activities and results to demonstrate the effectiveness of systems implemented to meet the companys policy and the requirements of this standard; 對供貨商的管制9.6 公司應(yīng)該建立和維持適當(dāng)?shù)某绦颍鶕?jù)供貨商達(dá)到本標(biāo)準(zhǔn)的能力,來評估和挑選供貨商。9.7 公司應(yīng)該維持適當(dāng)?shù)挠涗?,記載供貨商對社會責(zé)任的許諾,包括但不限于下列供貨商的許諾:a.) 符含本標(biāo)準(zhǔn)的所有規(guī)定 (包括本條規(guī)定);b.) 參加公司的要求監(jiān)督活動;c.) 及時(shí)補(bǔ)救任何違反本標(biāo)準(zhǔn)規(guī)定的事項(xiàng);d.) 及時(shí)全面地通知所有其它供貨商和分包商與公司的商業(yè)關(guān)系。9.8 公司應(yīng)該維持合理的證據(jù),來證明供貨商和分包商能夠達(dá)到本標(biāo)準(zhǔn)中的各項(xiàng)規(guī)定。Control of Suppliers9.6 The company shall establish and maintain appropriate procedures to evaluate and select suppliers based on their ability to meet the requirements of this standard;9.7 The company shall maintain appropriate records of suppliers commitment to social accountability, including, but not limited to, the suppliers written commitment to:b) participate in the companys monitoring activities as requested;c) promptly remediate any nonconformance identified against the requirements of this standard;d) promptly and completely inform the company of any and ail relevant business relationship(s) with other supplier(s) and subcontractor(s) ;9.8 The company shall maintain reasonable evidence that the requirements of this standard are being met by suppliers and subcontractors. 處理疑慮和采取糾正行動9.9 當(dāng)員工和其它利益團(tuán)體質(zhì)疑公司是否符合公司政策和/ 或本標(biāo)準(zhǔn)規(guī)定的事項(xiàng)之時(shí),公司應(yīng)該調(diào)查、處理和做出反應(yīng);員工如果提供關(guān)于公司是否遵守本標(biāo)準(zhǔn)的資料,公司不可對其采取懲罰、解雇或歧視的行為。9.10如果發(fā)現(xiàn)任何違反公司政策或本標(biāo)準(zhǔn)規(guī)定的事項(xiàng),公司應(yīng)該根據(jù)法規(guī)事項(xiàng)的性質(zhì)和嚴(yán)重性,分配相應(yīng)的資源實(shí)施適當(dāng)?shù)难a(bǔ)救和糾正行動。Addressing Concerns and Taking Corrective Action9.9 The company shall investigate, address, and respond to the concerns of employees and other interested parties with regard to conformance/nonconformance with the companys policy and/or the requirements of this standard; the company shall refrain from disciplining, dismissing or otherwise discriminating against any employee for providing information concerning observance of the standard.9.10 The company shall implement remedial and corrective action and allocate adequate resources appropriate to the nature and severity of any nonconformance identified against the companys policy and/or the requirements of the standard. 對外溝通9.11 公司應(yīng)該建立和維持與所有利益團(tuán)體經(jīng)常溝通的程序,就公司在執(zhí)行本標(biāo)準(zhǔn)各項(xiàng)要求上的表現(xiàn),提供相關(guān)的數(shù)據(jù)和資料,所提供的應(yīng)該包括但不限于管理審核和監(jiān)督活動的結(jié)果。Outside Communication9.11 The company shall establish and maintain procedures to communicate regularly to all interested parties data and other informati
