2025上海市房屋租賃合同英文版[2025ShanghaiResidentialLeaseAgreement]ThisLeaseAgreement(the"Lease")isenteredintoonthisdayof,2025,byandbetweenthefollowingparties:Landlord(出租人):Name:Address:Phone:Email:Tenant(承租人):Name:Address:Phone:Email:1.PropertyDescription(物業(yè)描述)TheLandlordagreestoleasetotheTenant,andtheTenantagreestoleasefromtheLandlord,thefollowingpremiseslocatedinShanghai,China(the"Premises"):Address:BuildingNo.:Floor/Unit:TotalArea:squaremetersThePremisesshallbeusedsolelyforresidentialpurposesinaccordancewiththelawsandregulationsofthePeople'sRepublicofChinaandthelocalregulationsofShanghai.2.LeaseTerm(租期)ThetermofthisLeaseshallcommenceonandendon(the"LeaseTerm").Unlessotherwiseagreed,theLeaseTermshallautomaticallyrenewforadditionalperiodsofmonthsunlesseitherpartyprovideswrittennoticeofterminationatleastdayspriortotheexpirationofthecurrentLeaseTerm.3.RentandPayment(租金及支付)TheTenantagreestopaytheLandlordamonthlyrentofRMB(大寫:Yuan整)forthePremises.Therentshallbepaidinadvanceonorbeforethedayofeachmonth.Latepaymentsshallincuralatefeeof%perdayontheoutstandingamount.TheTenantshallalsopayforallutilities,includingbutnotlimitedtowater,electricity,gas,andinternetservices,unlessotherwisestatedinthisLease.4.Deposit(押金)TheTenantshallpayasecuritydepositofRMB(大寫:Yuan整)totheLandlordwithindaysofsigningthisLease.ThesecuritydepositshallbereturnedtotheTenantwithindaysaftertheterminationoftheLease,providedthePremisesarereturnedinthesameconditionasreceived(normalwearandtearexcepted).5.UseofPremises(房屋使用)TheTenantshallusethePremisesforlawfulpurposesonlyandshallnotconductanyillegalactivitieswithinthePremises.TheTenantagreestomaintainthePremisesingoodconditionandtoreportanydamagesorrepairsimmediatelytotheLandlord.6.MaintenanceandRepairs(維護(hù)與修繕)TheLandlordshallberesponsibleforstructuralrepairs,includingbutnotlimitedtotheroof,walls,andfoundation.TheTenantshallberesponsibleforminorrepairsandroutinemaintenance,suchasfixingfixtures,appliances,andplumbing.TheLandlordmayenterthePremiseswithpriornoticetoperformrepairsorinspections.7.AlterationsandImprovements(改建與改善)TheTenantmaynotmakeanystructuralalterationsorimprovementstothePremiseswithoutthewrittenconsentoftheLandlord.Anynon-structuralimprovementsmustbeapprovedinwritingbytheLandlord.UponterminationoftheLease,theTenantshallrestorethePremisestotheiroriginalconditionunlessotherwiseagreed.8.AssignmentandSubletting(轉(zhuǎn)租與分租)TheTenantshallnotassignthisLeaseorsubletthePremiseswithoutthepriorwrittenconsentoftheLandlord.AnyunauthorizedassignmentorsublettingshallconstituteamaterialbreachofthisLease.9.Termination(終止)EitherpartymayterminatethisLeaseupontheoccurrenceofthefollowingevents:a)Non-paymentofrentforaperiodofconsecutivedays;b)BreachofanymaterialtermofthisLeasewhichremainsuncuredafterdays'writtennotice;c)Insolvencyorreceivershipofeitherparty;d)DestructionofthePremisesduetofire,flood,orotherunavoidablecauses.10.Defaultandremedies(違約及補救)IntheeventofadefaultbytheTenant,theLandlordshallhavetherighttoterminatethisLeaseandpursueanyavailablelegalremedies,includingbutnotlimitedtotherecoveryofdamages.TheTenantshallbeliableforanydamagescausedbytheirfailuretocomplywiththetermsofthisLease.11.GoverningLaw(適用法律)ThisLeaseshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina.DisputesarisingoutoforinconnectionwiththisLeaseshallberesolvedthrough友好協(xié)商(friendlynegotiation),andifunresolved,shallbesubmittedtothecompetentPeople'sCourtforadjudication.12.Notices(通知)Allnotices,demands,orcommunicationsrequiredorpermittedunderthisLeaseshallbeinwritingandshallbedeemedtohavebeendulygivenifdeliveredpersonallyorsentbyregisteredorcertifiedmail,returnreceiptrequested,totheaddressesofthepartiesassetforthabove.13.EntireAgreement(完整協(xié)議)ThisLeaseconstitutestheentireagreementbetweenthepartiesandsupersedesallpriororcontemporaneousunderstandings,agreements,orrepresentations,whetheroralorwritten,withrespecttothesubjectmatterhereof.NomodificationoramendmentofthisLeaseshallbeeffectiveunlessmadeinwritingandsignedbybothparties.14.Counterparts(副本)ThisLeasemaybeexecutedincounterparts,eachofwhichshallbedeemedanoriginal,butallofwhichtogethershallconstituteoneandthesameinstrument.INWITNESSWHEREOF,thepartiesheretohaveexecutedthisLeaseasofthedatefirstabovewritten.Landlord(出租人):Signature:Date:Tenant(承租人):Signature:Date:Witness(見證人):Name:Signature:Date:
