基層犯罪論文：湖南L縣農(nóng)村基層干部職務(wù)犯罪問題調(diào)查【中文摘要】農(nóng)村基層干部直接面對群眾,村干部就是黨和政府形象的代表者,老百姓從他們的一言一行中來認(rèn)識、評價黨和政府的形象。然而我國農(nóng)村基層一直以來因為監(jiān)管不到位、管理制度漏洞多而成為職務(wù)犯罪的高發(fā)點。目前對于農(nóng)村基層干部職務(wù)犯罪問題的研究者和成果是大多為實務(wù)部門的法律工作者,在實踐中根據(jù)當(dāng)?shù)厮痉顩r而提出的一些區(qū)域性的研究和對策。在司法實踐中,對農(nóng)村基層干部職務(wù)犯罪定性不清楚,處罰不當(dāng)甚至無法處罰,由此引起一些農(nóng)民因村干部的違規(guī)行為得不到法律懲處而反復(fù)上訪甚至爆發(fā)群體性事件的惡劣后果。嚴(yán)重影響的國家機關(guān)的正常工作秩序和農(nóng)業(yè)生產(chǎn)、農(nóng)民生活,造成了社會的不穩(wěn)定因素,破壞了社會和諧,同時也制約了農(nóng)村經(jīng)濟快速發(fā)展。因此,對不同地區(qū)的農(nóng)村基層干部職務(wù)犯罪問題,應(yīng)當(dāng)有針對性的進(jìn)行研究,分析其成因并制定相應(yīng)對策,以緩解目前干群關(guān)系緊張的局面,維護(hù)整個社會的和諧、促進(jìn)社會經(jīng)濟的可持續(xù)發(fā)展。首先,明晰什么人的何種行為才屬于農(nóng)村基層干部職務(wù)犯罪行列。其次,通過對大量案件的數(shù)據(jù)分析明確在統(tǒng)計地區(qū)農(nóng)村基層干部犯罪所呈現(xiàn)出來的某些特點。最后,則是應(yīng)從犯罪學(xué)和社會學(xué)等多種角度考慮,制定切實有效的法律監(jiān)督措施和社會監(jiān)管措施,有效預(yù)防和追查農(nóng)村地區(qū)新職務(wù)犯罪出現(xiàn)。本文提出:首先,對湖南中部地區(qū)L縣的全部已訴刑事案件進(jìn)行了統(tǒng)計,對其中涉及到農(nóng)村基層干部的部分職務(wù)犯罪進(jìn)行了具體的閱卷。在對相應(yīng)數(shù)據(jù)分析和排列組合后制作出表格,分析其中的特點,總結(jié)規(guī)律。進(jìn)而發(fā)現(xiàn)在該地區(qū)農(nóng)村基層干部職務(wù)犯罪所存在的普遍因素和個別因素。其次,通過對數(shù)據(jù)的分析和研究,發(fā)現(xiàn)了在該地區(qū)農(nóng)村基層干部職務(wù)犯罪產(chǎn)生了一定的演變。主體由過去的黨支部書記、村委會主任、村秘書、會計、出納等職位上的干部單干演變成了由這些人牽頭進(jìn)行“團伙作案”。犯罪持續(xù)的時間也更長,部分人員以“少食多餐”作為掩護(hù),長期從事職務(wù)犯罪活動。另外,隨著經(jīng)濟條件的好轉(zhuǎn),在引誘干部走向的犯罪道路上,賭博成為了新的重大誘因。建議在未來的刑法中明確關(guān)于農(nóng)村事務(wù)中公務(wù)行為、個人行為、集體行為等多種情況的標(biāo)準(zhǔn)或規(guī)定。對農(nóng)村基層的日常村務(wù)活動以省為單位制定和推行模板管理制度,由當(dāng)?shù)卮迕褡灾鬟x擇模板管理制度中應(yīng)當(dāng)增刪的相關(guān)條列。同時,作為社會監(jiān)管的組成部分,推行網(wǎng)絡(luò)到村。提高農(nóng)村基層的精神文明建設(shè),加強農(nóng)村基層干部文化修養(yǎng)的提高,從內(nèi)因上解決誘發(fā)犯罪提高的多種因素。【英文摘要】Grass-root cadres in villages serve the masses directly. Thus village officials represent the Party and the Government. From their words and behaviors, people know and judge our Party and Government. However, crimes by taking advantage of duty have commonly happened because of defective supervision and management system to the grass-root cadres. At present, the researches and achievement of such crimes to the grass-root cadres are mostly from lawyers of judicial departments of Practice. They come up with some regional studies and solutions according to the local justice conditions. In legal practices, there is no clear qualitative description to this kind of crime. As a result, some criminals can not be properly punished for their illegal behaviors or even not. Therefore, some villagers repeatedly petition higher authorities for help and even organize mass disturbances because of the illegal behavior of the village officials, which seriously disturbs the order of the government, agriculture production and villagerslife, brings instability to the society, breaks the harmony of our country, and sets back the development of rural economy. In this case, to post crimes from different regions, we should do relevant researches, and make corresponding strategies after analyzing their causes to ease the strained relationship between the officials and the mass, keep the harmonious society, and promote the substantial development of the economy. First, we should judge what kind of behavior from what kind of person belongs to post crime from grass-root cadres in villages. Second, through data analysis of a large number of cases, we can figure out some specific characteristics from such kind of crimes in the relevant regions. Finally, in terms of criminology, sociology and etc, we can work out efficient legal and social supervision measures to prevent and investigate those crimes alike.In this paper, firstly, all the criminal cases of L county in the middle area of Hunan province are calculated, among which about post crime of grass-root cadres in villages have been carefully studied. A chart has been made according to data analysis, permutation and combination. After studying the features of the chart, the prevalent and particular factors of post crimes in this region are found. Secondly, according to data analysis, the author finds that some changes have taken place in post crimes of this county. In the past, village officials, such as party branch secretary, head of villagers committee, secretary, accountant and cashier, committed post crime by themselves; however, gradually, those officials conspire with a gang. The criminal activities last longer. Under the guise of the principle of“eating small meals often”, some criminals engage in long-term crimes abusing power. Besides, as economy improves, gambling as a new major factor tempts officials to commit crimes.The author suggests that the standards and regulations of official behavior, personal behavior, and collective behavior in rural affairs should be clearly defined in future criminal laws. Management system patterns of daily rural affairs should be established and promoted in province. Local villagers can choose certain regulations in the management system patterns. In the meantime, internet , as one part of social supervision system, should be brought into villages.
