1、 東 莞 市房 地 產(chǎn) 租 賃 合 同Contract of Real EstateTenancies in Dongguang東莞市房地產(chǎn)租賃合同Contract of Real Estate Tenancies in Guangzhou出租人(甲方):Lessor (party A):承租人(乙方): Lessee (party B):經(jīng)紀(jì)方(丙方):東莞市迎龍房地產(chǎn)經(jīng)紀(jì)有限公司Agent(party C):根據(jù)國(guó)家、省、市有關(guān)法律、法規(guī)及房地產(chǎn)管理的各項(xiàng)規(guī)定,甲乙丙三方本著平等、自愿的原則,經(jīng)協(xié)商一致訂立本合同,并共同遵守,接受當(dāng)?shù)胤康禺a(chǎn)管理機(jī)關(guān)的監(jiān)督、管理。According to t
2、he related laws, Regulations and rules of real estate management by the country, province and city, both Parties concluded this contract through consultation adhering to the principles of equality and voluntary participation, and jointly comply with the contract. Both Parties subject their selves to
3、 supervision and management by the local real estate management office.一、甲方同意將坐落在_ _的房地產(chǎn)出租給乙方作 (按房屋使用性質(zhì)填寫)用途使用, 面積 平方米。1. Party A agrees to rent out the real estate located at to Party B for the use of office , construction area of m2.二、 乙雙方協(xié)定的租賃期限、租金情況如下:租賃期限月租金額(幣種:人民幣 )小寫大寫年月日至年月日年月日至年月日年月日至年月日租金
4、按 月 (月、季、年)結(jié)算,由乙方在每 月 (月、季、年)的第 日前按 付款方式繳付租金給甲方。 2. 5、f payment before_5_(date) of each month (month, season, year) to Party A by settlement of month _ (month, season, year).三、 乙方巳向甲方交納 保證金。并按照雙方簽訂的房地產(chǎn)租賃合同使用房屋,甲方應(yīng)在租賃期満或解除合同之日將保證金本金 退回乙方 。3. Party B has paid Party A deposit of (currency:RMB) RMB and uses the house according to the lease contract conclud
6、ed by both Parties. Party A shall return the deposit to Party B on the date of expiration or termination of the lease contract.四、在租賃期內(nèi),甲方承擔(dān)下列責(zé)任:4. Party A bears the following responsibility within the leasehold:1.依合同將房屋及設(shè)備交付乙方使用。未按約定提供房屋的,每逾期一日,須按月租金額的1 %向乙方支付違約金。4.1 The house and facilities shall b
7、e made available to party B by the contract. 1 % of monthly rent shall be paid to Party B as a fine per day if the house is not be available according to the contract.2. 甲方負(fù)責(zé)對(duì)房屋定期安全檢查,承擔(dān)房屋主體結(jié)構(gòu)自然損壞的維修費(fèi)用;如因房屋維修須乙方臨時(shí)搬遷時(shí),甲方應(yīng)與乙方簽訂回遷協(xié)議;如因甲方維修責(zé)任而延誤房屋維修造成他人人身傷亡、財(cái)產(chǎn)損失的,應(yīng)負(fù)責(zé)賠償。4.2 Party A shall make a regular s
8、afety check on the house and bear the maintenance cost of the natural damage of the main structure of the house. Party A and Party B shall conclude returning agreement if Party B has to move temporarily because of the maintenance of house. Party A shall compensate for the injury, death and loss of p
9、roperty caused by delay reparation of the house.3. 租賃期間轉(zhuǎn)讓該房屋時(shí),須提前1 個(gè)月書面通知乙方;抵押該房屋須提前15日書面通知乙方。4.3 When transferring the house within the leasehold, a written notice shall be sent to Party B ahead of 1 _months. Party A shall send a written notice to Party B ahead of 15 days before mortgaging the hous
10、e.4. 租賃期內(nèi),甲方如需提前解除合同,應(yīng)事前征得乙方同意。4.4 If Party A has to terminate the contract within the leasehold, Party A shall obtain consent from Party B ahead of time.五、租賃期內(nèi),乙方負(fù)責(zé)承擔(dān)下列責(zé)任:5. Party B bears the following responsibility within the leasehold:1. 依時(shí)交納租金。逾期交付租金的,每逾期一日,乙方須按當(dāng)月租金額的1 %向甲方支付違約金。如果逾期15日,甲方有權(quán)解除合
11、同,收回房屋。5.1 Pay the rent on time. Party B shall pay 1 % of the monthly rent to Party A as a fine per day delayed. If 15 days are overdue, Party A has the right to terminate the contract and call in the house.2. 嚴(yán)格按房屋使用性質(zhì)使用房屋。乙方擅自改變房屋用途,甲方可解除合同,收回房屋。5.2 Use the house strictly according to the usage of

If Party B unilaterally change the usage of the usage of the house, Party A has the right to terminate the contract and call in the house.3. 因使用需要對(duì)房屋進(jìn)行擴(kuò)、加、改建(含改變間隔)、室內(nèi)裝修或增加設(shè)備,必須經(jīng)甲方書面同意并訂立書面協(xié)議,并按規(guī)定重新議定租金,甲方有權(quán)對(duì)工程進(jìn)行監(jiān)督。5.3 If the house needs to be extended, added, reconstructed (including sp
13、ace changing), interior decorated or the addition of facilities, Party B shall get a written notice from Party A and conclude a written agreement. The rent shall be concluded again according to be regulations. Party A has the right to supervise the construction.4. 將房屋轉(zhuǎn)租、分租的,適用以下第 1 點(diǎn):5.4 The conditi
14、on of subleasing the house applies to the following 1 point: (1)、不得將房屋轉(zhuǎn)租或分租。如違反則視為乙方自動(dòng)放棄房屋使用權(quán),本合同在轉(zhuǎn)租或分租之日起解除,保證金不予退還,由此造成的一切損失,由乙方負(fù)責(zé)賠償。 If the subleasing of the house is not allowed. If Party B violates the contract,it is regarded that Party B voluntarily gives up the right of using the house. This
15、contract is terminated on the date of subleasing occurs. The deposit shall not be returned. Part B shall be responsible for all losses arising thereout. (2)、同意將房屋轉(zhuǎn)租或分租。必須簽定轉(zhuǎn)租合同,重新議定租金和其它合同條款并辦理租賃登記手續(xù)。 If the subleasing of the house is allowed. A sublease contract shall be made. The rent and other te
16、rms of the contract shall be concluded by both Parties. Subleasing register formal shall be transacted. 5. 愛護(hù)和正常使用房屋及其設(shè)備,發(fā)現(xiàn)房屋及其設(shè)備自然損壞,應(yīng)及時(shí)通知甲方并積極配合甲方檢查和維修,因乙方過錯(cuò)延誤維修而造成他人人身傷亡、財(cái)產(chǎn)損失的,乙方負(fù)責(zé)賠償;使用房屋不當(dāng)或者人為造成房屋損壞的,應(yīng)負(fù)責(zé)修復(fù)或賠償。5.5 Take care of and normally use the house and the facilities. When finding that the h
17、ouse and the facilities are in natural damaged, Party B shall inform Party A and coordinate with Party A to do check and reparation. Party B shall be responsible for the injury, death and loss of property due to delayed reparation of the house. Party B shall be responsible for the house reparation o
18、r compensation due to misusing or damaging created by man. 6. 乙方在承租的房屋內(nèi)需要安裝或者使用超過水、電表容量的任何水電設(shè)備,應(yīng)事前征得甲方同意,并由甲方負(fù)責(zé)到有關(guān)部門辦理增容手續(xù),費(fèi)用由乙方負(fù)擔(dān)。 5.6 Party B shall get promise from Party A when fixing or using any water or electrical devices which exceeds the capacities of water meter or electric meter inside the
19、 house tented. Part A shall go through the formalities of capacity expansion at the related department. Party B shall bear the fees.7. 注意防火安全,不得在房屋內(nèi)非法存放易燃、易爆等危險(xiǎn)物品。5.7 Pay attention to fire safety. Dangerous goods such as explosive goods, inflammable goods etc. are not allowed to be stored in the hou
20、se illegally.8. 租賃期內(nèi),乙方需提前解除合同的,應(yīng)事前征得甲方同意。5.8 When Party B wants to terminate the contract ahead of time within the leasehold, he must obtain consent from Party A ahead of time.9. 租賃期屆滿且甲方要求收回房屋或解除合同之日,應(yīng)交回原承租房屋和設(shè)備給甲方;如需繼續(xù)承租房屋,應(yīng)提前1個(gè)月與甲方協(xié)商,雙方另訂合同。5.9 On the date when the leasehold expires and Party A
21、wants to call in house or rescind the contract, Party B shall return the house and facilities to Party A. If Party B wants to rent the house continuously, he shall consult with Party A ahead of 1 months and both Parties shall conclude another contract. 六、違約責(zé)任:6. Responsibility of breach.1. 任何一方未能履行本
22、合同規(guī)定的條款或者違反房地產(chǎn)租賃管理法律、法規(guī),另一方有權(quán)依法提前解除本合同,造成的損失由責(zé)任方承擔(dān)。6.1 If one of the party can not perform the contract items or violate against laws/regulations of real estate tenancies management, the other Party has the right to terminate the contract. The Party bearing the responsibility shall undertake the los
23、s arising thereout.2. 租賃期屆滿,甲乙雙方未續(xù)定合同且甲方要求收回房屋,乙方逾期不交出承租房屋的,甲方除限期乙方遷出和補(bǔ)交占用期租金外,并有權(quán)按占用期內(nèi)租金總額的50%收取違約金。6.2 When the leasehold expires, if both Parties has not renewed the contract and Party A wants to call in the house, while Party B has not returned the house rented. Party A has the right to collect
24、a fine of 50 % of the rent sum according to the overdue time, and Party A may ask Party B to move out within the limited time and pay overdue rent.3. 租賃期內(nèi)任何一方無法定或約定的理由而單方提出解除合同的,另一方有權(quán)要求賠償損失,收取違約金 。6.3 During the leasehold, any Party in this contract shall not terminate the contract unless the situat
25、ion is clearly defined in the terms of this contract. Otherwise, the violator must pay a penalty of RMB to the observant as a result of breaching the contract.七、違約金、賠償金應(yīng)在確定責(zé)任后十日內(nèi)付清 ,每逾期一天,按應(yīng)付金額的1%支付滯納金。7. When the responsibility is determined, a contractual fine or compensation shall be paid within
26、10 days. A sum of 1 % overdue fine shall paid for each day overdue.八、在租賃期內(nèi),經(jīng)房屋安全鑒定部門鑒定房屋不符合安全使用標(biāo)準(zhǔn)時(shí),租賃合同自然終止,因此造成的損失由責(zé)任方負(fù)責(zé)賠償。8. Within the leasehold, when the house doesnt comply with safety use standard verified by the safety verification department, the tenancies contract terminates naturally. The
27、Party bearing the responsibility shall undertake the loss arising thereout. 九、如因不可抗力的原因,造成本合同無法履行時(shí),雙方互不承擔(dān)責(zé)任。9. If the contract can not be performed due to force major, neither of the parties bears the responsibility.十、本合同履行中發(fā)生爭(zhēng)議,雙方應(yīng)協(xié)商解決,協(xié)商不成時(shí),可采用下列第1種方式(只能選擇一種,同時(shí)選擇兩種無效)解決:10. When dispute occurs dur
28、ing the performance of the contract, the two parties shall consult to make settlement. If they can not make agreement, the following method of item 1 can be adopted to solve the problems: 1. 向廣州仲裁委員會(huì)(具體仲裁機(jī)構(gòu)名稱)申請(qǐng)仲裁;10.1 Apply for arbitration from GUANGZHOU ARBITATION COMMISSION .2. 向人民法院起訴。 在協(xié)商與訴訟期間,
29、雙方均不得采用任何方式威迫對(duì)方。10.2 Bring a suit in a Peoples Count.During the consultation and lawsuit, none of the parties is permitted to intimidate the other party in any way.十一、上述房屋在租賃期內(nèi),需要交納的費(fèi)用(電、水、管理費(fèi)用)和稅費(fèi),由乙方按規(guī)定承擔(dān)。(管理費(fèi)收費(fèi)標(biāo)準(zhǔn):3.5元/平方米)11. During the leasehold, Party B must pay for the utility charges (electricity water management fee) and taxes according to the contract.(the criterion of the management is 3.5/)十二、本合同未盡事宜,雙方可另行簽定補(bǔ)充協(xié)議,但內(nèi)容不得違反國(guó)家、省、市有關(guān)法律和法規(guī),如與本合同有抵觸且補(bǔ)充協(xié)議中不作注明的,以東莞市房地產(chǎn)租賃合同為準(zhǔn)。其補(bǔ)充協(xié)議經(jīng)雙方簽章和房地
