9、循自愿、公平、公正和誠實信用的原則,經(jīng)甲乙雙方就射洪中央景峰項目鋼筋工程合作事項協(xié)商一致,特訂立本合同如下:一、工程概況及承包內(nèi)容1、工程名稱:2、 工程概況:3 、 結(jié)構(gòu)形式:4、承包范圍:(1)、從筏板基礎(chǔ)鋼筋開始到主體結(jié)構(gòu)頂為止的全部制作和安裝,(注:預(yù)制和現(xiàn)澆構(gòu)件的鋼筋,磚墻拉結(jié)筋、構(gòu)造柱、過梁、預(yù)埋、焊接;預(yù)埋鐵鋼筋、屋面鋼性層等本工程圖紙及規(guī)范要求的所有鋼筋工程的制作、安裝及焊接工作(乙方不包括框架主體的板筋、箍筋的制作,但砌體拉結(jié)筋和箍筋的制作,由乙方安排加工)。筏板和轉(zhuǎn)換層鋼筋的腳手架的搭設(shè),后澆帶鋼絲網(wǎng)的安裝和加固。( 2)、焊接工程包括:本工程規(guī)范允許焊接的所有焊接工作的人
10、工及相應(yīng)的焊接材料,包括電渣壓力焊及筏板鋼筋連接工料。二次結(jié)構(gòu)的植筋由項目部負(fù)責(zé)。( 3)、鋼筋工程包括:原材料進場配合卸車,加工場所有鋼筋運輸至施工現(xiàn)場人工上下車(運輸工具由甲方提供),場內(nèi)運輸卸貨就位,分類堆放整齊,場內(nèi)二次搬運,制作和綁扎、安裝鋼筋,垂直、水平運輸,馬凳保護層,制作、安放墊塊保護層,澆砼時鋼筋值班保證負(fù)筋保護層正確,及時利用短鋼筋,現(xiàn)場短鋼筋清理堆放整齊。( 4)、鋼筋的制作和綁扎需要的扎絲和焊條.焊藥以及機具由乙方承擔(dān)。(5)、承包人根據(jù)工程需要向發(fā)包人承諾的施工作業(yè)人員不少于名(本合同自乙方達到規(guī)定人數(shù)后開始生效)。二、合同工期:1、開工日期:年月日,竣工日期:年月日

23、thening "four good" leadershipconstruction3、乙方必須按照甲方項目部的要求安排人員,如乙方不能達到甲方的要求,甲方有權(quán)依據(jù)現(xiàn)場情況另行增派班組或者更換乙方。三、合同單價1、地下室筏板部分:(工程量按圖計算)2、地下室筏板以上:(工程量按圖計算)3、工程量增減: 如發(fā)生圖紙范圍內(nèi)的變更, 所產(chǎn)生的增減工作量甲方不另行計算, 即包含在每平方米承包價范圍內(nèi)(工期不順延) 。四、工程款的支付辦法1、工程進度款支付辦法:按工程進度節(jié)點撥付工程款( 1)、地下室部分:( 2)、商業(yè)部分:( 3)、住宅:( 4)、工程主體完成后支付完成的層以上工
24、程量的80%。( 5)、余款在工程屋面剛性層鋼筋完成后一個月內(nèi)支付至,余款在工程竣工驗收后一年內(nèi)付清。( 6)、以上均為完成節(jié)點工作后乙方報送此段已完成工程量,甲方審核后支付工程款。2、乙方必須按設(shè)計及相關(guān)規(guī)范保證質(zhì)量,如乙方完成部分需要整改或者有相關(guān)的遺留問題必須在撥付工程進度款之前處理完成,否則不予撥付工程款。3、乙方必須按照甲方及項目部的進度計劃要求進行合理安排,滯后的工期必須及時安排趕上,如工期已經(jīng)滯后且乙方未合理安排時,甲方或項目部有權(quán)組織突擊班組進行突擊,費用由乙方支付,高出平常工資部分由乙方負(fù)責(zé)補足,在工期未趕上計劃工期之前不予撥付工程進度款。4、乙方必須聽從甲方及項目部的指揮和
25、安排,不得野蠻施工,如乙方拒不聽從,甲方及項目部有權(quán)停撥工程款,必要時更換班組,乙方工程款必須待工程達到工程款撥付節(jié)點后方能結(jié)算工程款。五、工人工資的發(fā)放辦法1、承包人保證工人進場時,嚴(yán)格參照中華人民共和國勞動法及其法規(guī)同每位工人簽訂勞動合同,記載勞動合同期限、工作內(nèi)容和工作地點、工作時間和休息休假、勞動報酬及其支付方式、社會保險、勞動保護、勞動條件、勞動安全和職業(yè)危害防護。2、乙方應(yīng)在工人進場時必須如實將所有參與本項目施工的員工的基本信息報甲方備案,記載姓名、性別、年齡、籍貫、公民身份號碼、聯(lián)系電話、職位,年齡不滿18 周歲和已滿55 周歲以上的人員不得進場施工作業(yè),所有人員必須配合甲方在當(dāng)

39、uot; leadershipconstruction3、乙方必須接受甲方及項目部對乙方施工人員的上班人員的考勤監(jiān)督和考勤制度(指紋卡或平安卡記錄),對乙方上班人數(shù)、工作部位每天進行公示,承包人第二天根據(jù)公示情況提交詳細的考勤,如承包人提供虛假考勤,甲方有權(quán)按所涉金額的10 倍進行處罰,因此引起的責(zé)任由乙方承擔(dān)。4、甲方只負(fù)責(zé)按合同支付乙方勞務(wù)進度款;乙方發(fā)放工人勞務(wù)工資金額不足的,由乙方自行解決。乙方須參照勞動法律法規(guī)和勞務(wù)合同的規(guī)定按時全額發(fā)放工人勞務(wù)工資。5、為了保證本合同的全面履行和不引發(fā)勞務(wù)糾紛,乙方收取工程款時, 必須提供由工人簽名的工資發(fā)放表,原件交由甲方備案;甲方有權(quán)優(yōu)先將工程
40、進度款直接發(fā)放工人工資,扣除工人工資后向乙方支付工程進度款。乙方在工人工資全額發(fā)放前,挪用工程進度款的視為違約行為,應(yīng)承擔(dān)違約責(zé)任。6承包人領(lǐng)取工資后,必須按實際現(xiàn)場工人名字出具工資表,由工人本人簽字和蓋手印,提供與甲方。7、如乙方未按時全額發(fā)放工人勞務(wù)工資而出現(xiàn)工人罷工、鬧事、上訪時,乙方應(yīng)當(dāng)優(yōu)先無條件解決糾紛,阻止工人罷工、鬧事,立刻支付拖欠的工人工資。施工現(xiàn)場如因勞務(wù)糾紛引發(fā)罷工、鬧事、上訪等事件,甲方按 10000 元 /起對承包人進行罰款,罰款在當(dāng)月工程進度款中扣除。8、如發(fā)生勞務(wù)糾紛,乙方無能力及時處理,而乙方工人需甲方出面解決時,乙方同意根據(jù)實際出勤人數(shù)及相關(guān)工資標(biāo)準(zhǔn)結(jié)算退場;如
41、造成甲方經(jīng)濟損失,乙方同意全部承擔(dān)。六、安全施工1、進入施工現(xiàn)場的乙方人員,必須遵守施工現(xiàn)場的各項規(guī)章制度。2、進入施工現(xiàn)場必須正確佩戴安全帽,高空作業(yè)必須系好安全帶,特種作業(yè)時必須按要求配戴(備)相應(yīng)的安全防護措施。3、進入施工現(xiàn)場作業(yè)人員必須熟練掌握各項操作規(guī)程,嚴(yán)格按照相關(guān)操作規(guī)程操作,不得違章操作。4、進入施工現(xiàn)場的乙方人員,不得私拉亂接電線路,需要時必須要由專業(yè)電工操作。5、工人在施工現(xiàn)場中違反安全操作規(guī)程及紀(jì)律。甲方視情節(jié)輕重可處罰款50 200 元。6、以上各項必須嚴(yán)格執(zhí)行,如有違規(guī)操作或者非法操作,項目部有權(quán)按照施工現(xiàn)場相關(guān)規(guī)定進行相應(yīng)處罰,造成后果的由乙方負(fù)責(zé),屢教不改的甲方
42、及項目部有權(quán)責(zé)令當(dāng)事人及乙方及時退場。并執(zhí)行先退場后算賬的規(guī)定。七、文明施工1、進入施工現(xiàn)場必須遵守施工現(xiàn)場各項文明施工管理規(guī)定,必須服從甲方及項目部管理人員統(tǒng)一指揮和安排,維護公司形象。2、進入施工現(xiàn)場必須文明穿著,男同志不得穿拖鞋及赤身,女同志不得穿高跟鞋及穿裙子。3、嚴(yán)禁酒后上班、疲勞作業(yè),嚴(yán)禁在施工現(xiàn)場隨地大小便。4、施工現(xiàn)場及宿舍內(nèi)嚴(yán)禁打架斗毆,聚眾賭博、尋釁滋事。play levels cadres i n enterprisedevelopment in the ofbackbone backbone role; t o full strengtheni ng members y
