2、:*Legalrepresentative:*Position:GeneralManagerNationality:China甲、乙方代表通過友好協(xié)商2013年3月6日簽訂。ThecontractisherebyconcludedbybothpartiesthroughfriendlynegotiationonMarch6th,2013.第一條總則1.GeneralProvisions1. 甲方負責(zé)負責(zé)提供項目(鋼琴組裝)，乙方公司負責(zé)提供勞務(wù)。(1) PartyAshalloffertheproject(Pianoassembly),PartyBshallofferlaborforce(Em

3、ployee).2. 本合同自簽字之日起生效，直至雙方間全部遺留問題，包括財務(wù)問題處理完畢之日止。3. )Thecontractshallbevalidsincethedateofsignatureandwillterminateuntilallremainingproblemssolved,includingthefinancialproblems.第二條人員2 Employee乙方公司“提供人數(shù)、派遣日期和工作期限，為本項目派出其授權(quán)代表、各類技術(shù)人員、工人、管理和服務(wù)人員(以下簡稱“人員”)。PartyBshalloffernumberofthepeople,dispatchdatean

4、dworkingtermandshalldispatchtheauthorizedrepresentative,technicians,workers,managementandservicepeople(hereafterreferasemployee)(1) 人員離境之前如需變更時，甲方應(yīng)將變更內(nèi)容提前一個月書面通知乙方，如甲方變更計劃未能及時通知乙方公司，而乙方公司已按計劃集中人員和訂購機票，甲方應(yīng)負擔(dān)因此造成的損失。(1)PartyAshallnotifyPartyBonemonthearlierforthechangesonemployeebeforetheyleavechina.I

6、dothercertificate1. 乙方應(yīng)按中國政府的有關(guān)規(guī)定辦理人員出入中國國境的一切必要手續(xù)，并承擔(dān)其費用。PartyBshallhandleallnecessaryproceduresofExit-EntryforemployeeinaccordancewithlawandregulationsofChineseGovernmentandbearthecharges.2. 甲方應(yīng)按項目所在國政府的有關(guān)規(guī)定辦理人員出入項目所在國及居留、工作許可證、等相關(guān)手續(xù)，并承擔(dān)費用。PartyAshallhandleresidencepermit,workpermitandotherrelevan

7、tproceduresforemployeeinaccordancewithPartyAcountry'sregulationsandbearthecharges.3. 如果甲方未能為人員獲得在項目所在國的居留、工作許可證和相關(guān)手續(xù)，而使人員無法進行工作，應(yīng)付給人員在此期間的合同工資。如人員因此被迫返國時，甲方應(yīng)負擔(dān)人員的回程旅費，并支付每人_1_個月合同工資的賠償費。3.1 fpartyAdidnotobtaintheresidencepermit,workpermitandrelevantprocedurestoresulttheemployeecannotwork.PartyAw

PartyB'sobligations1. 符合雙方商定的技術(shù)條件；Employeeisqualifiedfortechnicalrequirementsagreeduponbytwoparties2. 遵守項目所在國的法律和法令，尊重當(dāng)?shù)仫L(fēng)俗習(xí)慣

9、；Employeeshouldabidebyworksitecountrylawsandregulationsandrespectlocalcustomsandhabits.3. 尊重甲方人員的技術(shù)指導(dǎo)；EmployeeshouldrespecttechnicalguidanceofPartyA4. 不參與項目所在國的任何政治活動；Employeeshallnottotakepartinanypoliticalactivities.5. 遵守公司的規(guī)章制度；Employeeshallabidebycompanyrulesandregulations6. 與甲方為實施本項目而雇傭的其他國籍的人員

10、合作共事。6.EmployeecanworktogetherwithotherforeignersemployedbyPartyAforthementionedproject.第五條甲方的義務(wù)PartyA'sobligations1. 對人員給予正確的技術(shù)指導(dǎo)；PartyAshallprovidecorrecttechnicalguidancetoemployee2. 尊重人員的人格、風(fēng)俗和習(xí)慣；PartyAshallrespectemployeepersonality,customsandhabits.3. 不干涉人員在非工作時間的活動自由；PartyAshallnotinterve

11、neemployeeactivitiesduringnonworkingtime.4. 保障人員的安全；PartyAshallguaranteeemployeesafety.5. 對人員的解雇和更換，應(yīng)由雙方的授權(quán)代表商定。Anydismissalandreplacementonemployeeshallbeconsultedbybothparty'srepresentatives.第六條；每天工作時間安排可由甲、乙方公司授權(quán)代表商定6. 12、ve.2.凡由于待料、停電、氣候惡劣等非人員的責(zé)任而造成的停工，應(yīng)計為工作時間，合同工資照付。Anyshut-downscausedbynomaterial,powercut,badweatherandothernonartificialfactorsshallbecountasworkingtimeandpaidasusual.第七條合同工資ContractSalary1.人員的月工資(包括伙食費)在本合同有效內(nèi)按以下標(biāo)準(zhǔn)支付(美元)：后付工資標(biāo)準(zhǔn)表。Employeemonthlysalary(includingfoodexpenses)shallbepaidbyUSDaccordingto

13、thefollowingstandardsduringthevalidityofthelaborcontract.Attachmentheretothewagesschedulesheet.(1) 服務(wù)人員Serviceperson(2) 熟練技工，廚師Skillfulmechanic,chef(3) 技術(shù)員，翻譯，Technicianandinterpreter(4) 工程師，Engineer(5) 授權(quán)代表Authorizedrepresentative第八條夜班及加班8.Nightshiftandovertime1.根據(jù)項目的需要，甲方要求人員在夜間工作或加班，應(yīng)取得乙方授權(quán)代表同意，(

14、1)Ifnecessaryforwork,PartyAmay,onthebasisofnegotiationwithPartyBrepresentative,requestemployeeworknightshiftorovertime.2.夜間時間系指從當(dāng)日晚上9時至次日晨5時。人員夜間工作(指正常夜班工作)甲方應(yīng)按合同工資150%支付工資；人員夜間加班，甲方應(yīng)按合同工資200%支付加班費。(2)Nightshifttimesfrom9:00PMtothesecondmorning5:00AM.Nightshift(Socialworkhoursatnight).PartyAshallpay

15、wages150%accordingtothecontractsalary.Forovertimeatnight,PartyAshallpaywages200%accordingtothecontractsalary.第九條工資支付9Remuneration乙方公司的授權(quán)代表應(yīng)按甲方提供的表格填寫工作時間和加班時間，編制工資單，在每月工資結(jié)算日即28日提前2天內(nèi)提交甲方的授權(quán)代表審核批準(zhǔn)。PartyBrepresentativeshallfillintheformofferedbyPartyAwithemployee'sworkingtimeandovertimeandsubmitto

17、ce1. 乙方為人員自其離開中國之日起至返抵中國之日止。在中國投保人身意外險，保險費由雇主承擔(dān)。甲方應(yīng)隨同人員的月合同工資以美元一并向中國公司支付每人每月_保險費。1 .PartyBshallparticipateinaccidentinsuranceforemployeestartfromthedateofleavingchinaandendtothedateofthereturn.PartyAshallpayinsurancepremiumstogetherwithemployeesalarytoPartyBChinacompanyinUSDmonthly.2. 人員在中國投保人身意外險后

18、，如經(jīng)甲方要求，乙方可向甲方提供必要的證明文件，以避免甲方為人員在項目所在國重復(fù)投保。AfteremployeeparticipateinpersonalaccidentinsuranceinChina.PartyBshalloffertherelevantinsurancecertificatestoPartyAiftheyrequire,inordertoavoidPartyAbuymultipleinsurance第十五條醫(yī)療和病假15.Medicaltreatmentandsicknessleaves1. 甲方應(yīng)為人員在整個合同期間因病或因工傷提供免費醫(yī)療、藥品和住院治療。2. 人員在
