ckingmaterial.ifwoodenpalletsorcasesareused,theremustbefumigationmarklike“ippc”or“nimp15”onthewoodenpalletsorcases,andbetteraccompanywitharelevantfumigationcertificate.無木質(zhì)包裝申明8)declarationofbottlingdateforeachoilwiththeformofyear-month-date灌裝日期9)10%ofthetotalbottlequantityoforiginalcopiesoffrontlabelsandbacklabelsforeachoil,min20sets.前后標(biāo)10)twooriginalofthiscontract.協(xié)議11)onecertificateissuedbylocalchamberofcommercetoprovetherealityofthecargovalue,indicatingthecontractno.廠商申明12)onecopyoftheinsurancepolicy保單13)onecopyofthetransportationinvoicefromtheforwarder運(yùn)輸發(fā)票14)onecopyofexportdeclarationwhichcanshowtheexportvalueoftheoils顯示貨物出口值出口報(bào)關(guān)單9.cargopre-check:aftertheproductionbutbeforetheloadingofthecargo,thesellershouldtakepicturesofeachtypeofoilwhichcanclearlyseethecontentoffrontandbacklabelsforpre-check.anycostorlossshouldbeburdenbythesellerifthesellerdoesn’tsendthepicturesforpre-check.貨物預(yù)檢驗(yàn):生產(chǎn)后,裝運(yùn)前貨物,賣方應(yīng)為每個(gè)產(chǎn)品品項(xiàng)拍照,照片能夠清楚地看到正面和后面標(biāo)簽作為預(yù)檢驗(yàn)內(nèi)容。假如賣方不發(fā)送圖片預(yù)檢驗(yàn),造成任何損失應(yīng)該由賣方負(fù)擔(dān)10.documentspre-check:thesellershouldsendthebuyeralltheabovementioneddocumentsandclearcolorscanfrontandbacklabelsforpre-checkwithin7workingdaysafterb/ldate.thebuyershouldfinishcheckingin2workingdaystheninformthesellerforcorrectionifany.anycostorlossshouldbeburdenbythesellerifthesellerdoesn’tsendthedocumentsforpre-check.文件預(yù)檢驗(yàn):賣家應(yīng)買家要求發(fā)送上述全部文件,b/l日期后7個(gè)工作日內(nèi)發(fā)送清楚標(biāo)簽彩色正面和后面掃描件。買方應(yīng)在2個(gè)工作日內(nèi)完成檢驗(yàn),如有更正,通知賣家。假如賣方不發(fā)送文件預(yù)檢驗(yàn),造成任何損失應(yīng)該由賣方負(fù)擔(dān)。11.documentsdelivery:thesellershouldsendtheoriginaldocumentstothebuyeratleast10daysbeforethearrivalofthecargo.thesellershouldburdenallthecostorlossduetolatedeliveryofdocuments.thebuyerhastherighttoreturnthecargoorrefusepaymentifthecargoundergoesdeteriorationbyinsolationduetoincorrectorlatedocuments.文件發(fā)送:賣方應(yīng)在到貨前最少10天前發(fā)送文件正本。賣方應(yīng)負(fù)擔(dān)因?yàn)檠舆t交付文件損失。若因賣方交付文件不正確或延遲交付所造成貨物暴曬變質(zhì),買方有權(quán)返回貨物或拒絕付款。sellershouldprintandstickchinesebacklabelsthesellershouldprintthesamplechinesebacklabelandscantothebuyerforconfirmationbeforesticktothebottle.漢字背標(biāo):買方發(fā)送賣方pdf/ai格式漢字背標(biāo)。賣方應(yīng)在法國印制并黏貼漢字背標(biāo)。賣方在黏貼漢字背標(biāo)前應(yīng)印制漢字背標(biāo)樣板并發(fā)送買方確定。15.shipment:thesellershallarrangethegoodtobeshippedoutwithintheshippingtime.transshipmentisnotallowed.thecarryingvesselshallnotflytheflagofcertainnationunacceptabletothebuyer.裝運(yùn):賣方應(yīng)在出貨時(shí)間內(nèi)安排好裝運(yùn)運(yùn)出。轉(zhuǎn)運(yùn)是不許可。裝運(yùn)船只不得懸掛買方不接收一些國家國旗。16.shippingadvice:thesellershallimmediatelyuponthecompletionoftheloadingofthegoods,advisebyfaxthebuyerofthecontractnumber,commodity,quantity,invoicevalue,grossweight,netweight,nameofvessel,portofshipmentandportofdestinationanddateofsailingordateofdispatchetc.裝運(yùn)通知:賣方應(yīng)在貨物裝船完成后,立刻經(jīng)過傳真通知買方協(xié)議號(hào),品名,數(shù)量,發(fā)票價(jià)值,毛重,凈重,船名,裝運(yùn)港口和目港口和發(fā)船日期或日期調(diào)整等。19.forcemajeure:thesellershallnotbeheldresponsibleforthedelayinshipmentornon-deliveryofthegoodsduetoforcemajeure,whichmightoccurduringtheprocessofmanufacturingorinthecourseofloadingortransit.thesellershalladvisethebuyerimmediatelyoftheoccurrencementionedaboveandwithinfourteendaysthereafter,thesellershallsendbyairmailtothebuyerfortheiracceptanceacertificateoftheaccidentissuedbythecompetentgovernmentauthoritiesorthechamberofcommercewheretheaccidentoccursasevidencethereof.undersuchcircumstancestheseller,however,arestillundertheobligationtotakeallnecessarymeasurestohastenthedeliveryofthegoods,incasetheaccidentlastsformorethan10weeks,thebuyershallhavetherighttocancelthecontract.不可抗力:賣方不負(fù)擔(dān)因可能發(fā)生在制造過程中或在裝載或運(yùn)輸過程中不可抗力造成延遲交貨或不交付責(zé)任。賣方應(yīng)在上述情況發(fā)生十四日內(nèi)立刻通知買方,賣方應(yīng)通過航空郵件發(fā)送由政府主管部門或商會(huì)商務(wù)部頒發(fā)事故證書作為證據(jù)。然而,在這種情況下,賣方仍有義務(wù),采取一切必需方法,以加速交付貨物,假如事故連續(xù)超出10周,買方有權(quán)撤銷協(xié)議。20.latedeliveryandpenalty:shouldthesellerfailtomakedeliveryontimeasstipulatedinthecontractwithexceptionofforcemajeurecausesspecifiedinabovearticleofthiscontract,thebuyershallagreetopostponethedeliveryonconditionthattheselleragreetopayapenaltywhichshallbedeductedbythepayingbankfromthepaymentundernegotiation.thepenalty,however,shallnotexceed5%ofthetotalvalueofthegoodsinvolvedinthelatedelivery.therateofpenaltyischargedat0.5%ofthetotalvalueofthegoodsforeveryday.incasethesellerfailtomakedelivery15dayslaterthanthetimeofshipmentstipulatedinthecontract,thebuyershallhavetherighttocancelthecontractand,thesellerinspiteofthecancellation,shallstillpaytheaforesaidpenaltytothebuyerwithoutdelay.假如賣方無法按協(xié)議要求按時(shí)交貨,除本協(xié)議上訴不可抗力原延期交貨違約金:因要求買方應(yīng)同意推遲交貨情況下,賣方在協(xié)商下應(yīng)支付罰款,由付款銀行在議付貨款中扣除。然而,罰款不得超出延期交付貨物總價(jià)值5％。罰金率,天天按貨物總價(jià)值0.5％收取。賣方未能在協(xié)議要求裝運(yùn)時(shí)間后15天內(nèi)交貨,買方應(yīng)有權(quán)撤銷協(xié)議,賣方仍然應(yīng)該向買方支付上述罰款,不得延遲。21.return:thebuyerhastherighttoreturnthegoodsifanygoodsthebuyerimportedfromthesellerrunsafoulof,orislimitedbytherelatedlawstatuteandpolicyorlocalregulationsofthebuyer’scountry/pre-sal
