NoconcurrentcontractinvolvingtheareaorperiodcoveredinthiscontracthasbeenorwillbeenteredintobythesellerwithoutthewrittenconsentofthePurchaser.

ThePurchaserandhisemployeesshallhaveaccesstotheareaatallreasonabletimesandseasonsforthepurposeofcarryingoutthetermsofthiscontract.

TheSellercovenantsthatheisthelawfulowneroftheabovetimberandthatnoindebtednessorencumbranceexistsagainstthesame.

PURCHASER

ThePurchaserfurtheragreestocutandremovethetimberconveyedinthecontractinstrictaccordancewiththefollowingconditions:

UnlessanextensionoftimeisagreeduponinwritingbetweentheSellerandthePurchaser,alltimbershallbecutandremovedonorbeforeandnotlatterthenthe_____dayof__________,andanymaterialnotsoremovedshallreverttotheSeller.

Onlymarkedtreesshallbecut.Unmarkedtreesandyoungtimbershallbeprotectedagainstunnecessaryinjuryfromfellingandloggingoperations.

ThePurchasershallclearnecessaryloggingroadsonlyaftertheirlocationshavebeendefinitelyagreeduponwiththeSellerorhisrepresentative.

Duringthelifeofthiscontractandontheareacovered,careshallbeexercisedbythePurchaserandhisemployeesagainstthestartingandspreadingoffireandtheyshalltakereasonableprecautiontopreventandcontrolfires.

FencedamagedordestroyedbythePurchaserintheloggingorremovaloftimberincludedinthiscontractshallberepairedorreplacedbythePurchasertotheconditionsexistingatthetimetheloggingbegins.

Anyliabilityfordamage,destruction,orrestorationofprivateorpublicimprovementsoccasionedbyorintheexerciseofthiscontractshallbethesoleresponsibilityofthePurchaser.

Alllitterandgarbagecreatedbytheloggersand/orloghaulersistheresponsibilityofthePurchaserandistobepickedupweekly.

BestManagementPracticeswillbefollowedtoensureminimumimpactonwaterresourcesbothonsiteanddownstream.

INSURANCE

ThePurchaserherebyagreestoprotect,indemnify,andsaveharmlesstheSellerfromanyandallliabilityforpersonalinjuries,deathand/orpropertydamagesufferedorincurredbyanypersoninconnectionwiththePurchaser'sperformanceofthiscontract.ThePurchaseralsoagreestofurnishinsuranceofthefollowingtypes

GeneralLiabilityInsuranceintheamountof$_________________________,andlisting______________________asadditionalinsuredonsaidpolicy.

Worker'sCompensationInsuranceforallpersonsusedintheharvestofthetimber.

MISCELLANEOUS

SellerandPurchasermutuallyagreeasfollows:

Allmodificationsofthiscontractwillbereducedtowriting,dated,signedandwitnessed,andwillbeattachedtothiscontract.

ResaleofanyportionofthestandingtimberconveyedbythiscontractwillnotreleasethePurchaserfromanyorallthetermsofthiscontractunlesstheSellersignsawrittenrelease.

Incaseofdisputeoverthetermsofthiscontract,finaldecisionshallrestwithareputablepersonmutuallyagreeduponbypartiestothiscontract.Inthecaseoffurtherdisagreement,finaldecisionshallrestwithanapprovedboardofthreepersons,onetobeselectedbyeachpartytothiscontractandthethirdtobeselectedbytheothertwo.
