3、hall adhere to the principle of combining the efforts of both specialized organizations and the masses and carry out responsibility system on fire prevention and safety. 第三條 消防工作由國務(wù)院領(lǐng)導(dǎo)，由地方各級人民政府負(fù)責(zé)。Article 3 The State Council shall led and the people's governments at all levels be responsible for

4、 fire control work. 各級人民政府應(yīng)當(dāng)將消防工作納入國民經(jīng)濟(jì)和社會發(fā)展計劃，保障消防工作與經(jīng)濟(jì)建設(shè)和社會發(fā)展相適應(yīng)。 The people's government at all levels shall bring fire control work in line with the national economy and social development plan, and ensure that fire control work fit in with the economic construction and social development. 第

5、四條 國務(wù)院公安部門對全國的消防工作實施監(jiān)督管理，Article 4 The public security department of the State Council shall monitor and administer the nationwide fire control work; 縣級以上地方各級人民政府公安機(jī)關(guān)對本行政區(qū)域內(nèi)的消防工作實施監(jiān)督管理，并由本級人民政府公安機(jī)關(guān)消防機(jī)構(gòu)負(fù)責(zé)實施。the public security organs of local people's governments above county level shall monitor

6、and administer the fire control work within their administrative region and the fire control institutions of public security organs of the people's government at the same level shall be responsible for the implementation. 軍事設(shè)施、礦井地下部分、核電廠的消防工作，由其主管單位監(jiān)督管理。 Fire control work for military facilities

7、, underground parts of mines and nuclear power plant shall be monitored and administered by their competent units. 森林、草原的消防工作，法律、行政法規(guī)另有規(guī)定的，從其規(guī)定。 For fire control work on forest and grassland, in cases there are separate regulations, the separate regulations shall be followed. 第五條 任何單位、個人都有維護(hù)消防安全、保護(hù)消

8、防設(shè)施、預(yù)防火災(zāi)、報告火警的義務(wù)。Article 5 Any unit and individual shall have the obligation of keeping fire control safety, protecting fire control facilities, preventing fire disaster and reporting fire alarm. 任何單位、成年公民都有參加有組織的滅火工作的義務(wù)。 Any unit and adult shall have the obligation to take part in organized fire fi

9、ghting work. 第六條 各級人民政府應(yīng)當(dāng)經(jīng)常進(jìn)行消防宣傳教育，提高公民的消防意識。 Article 6 The people's government at all levels shall carry out regular fire control propaganda and education and strengthen citizens' awareness on fire control. 教育、勞動等行政主管部門應(yīng)當(dāng)將消防知識納入教學(xué)培訓(xùn)內(nèi)容。 Administrative department on education and labor shall

10、 put fire control knowledge into teaching and training. 新聞、出版、廣播、電影、電視等有關(guān)主管部門，有進(jìn)行消防安全宣傳教育的義務(wù)。 Competent departments in journalism, publishing, broadcasting, movie and television sector shall have the obligation to conduct propaganda and education on fire control safety. 第七條 對在消防工作中有突出貢獻(xiàn)或者成績顯著的單位和個人，

11、應(yīng)當(dāng)予以獎勵。 Article 7 Units and individuals who make prominent contribution or achievements in fire control work shall be awarded. 第二章 火災(zāi)預(yù)防 CHAPTER TWO FIRE PREVENTION 第八條 城市人民政府應(yīng)當(dāng)將包括消防安全布局、消防站、消防供水、消防通信、消防車通道、消防裝備等內(nèi)容的消防規(guī)劃納入城市總體規(guī)劃，并負(fù)責(zé)組織有關(guān)主管部門實施。Article 8 Urban people's governments shall bring the fi

12、re control plan into the overall urban planning, including fire control safety layout, fire control station, fire control communication, fire truck passageway and fire control equipment, etc, and take the charge of organizing relevant departments for its implementation. 公共消防設(shè)施、消防裝務(wù)不足或者不適應(yīng)實際需要的，應(yīng)當(dāng)增建、

13、改建、配置或者進(jìn)行技術(shù)改造。In case public fire control facilities and equipage are insufficient or do not fit in with actual demand, efforts should be made on expansion, rebuilding, allocation and purchase or technical reform. 對消防工作，應(yīng)當(dāng)加強(qiáng)科學(xué)研究，推廣、使用先進(jìn)消防技術(shù)、消防設(shè)備。Science research and promotion on fire control work sh

14、ould be reiterated and advanced fire control technology and equipage should be adopted. 第九條 生產(chǎn)、儲存和裝卸易燃易爆危險物品的工廠、倉庫和專用車站、碼頭，必須設(shè)置在城市的邊緣或者相對獨立的安全地帶。Article 9 Existing factories and warehouses and specialized depots and wharves for production, storage, loading and unloading of inflammable and explosive

15、dangerous goods, shall be established at urban border area or independent safety zone. 易燃易爆氣體和液體的充裝站、供應(yīng)站、調(diào)壓站，應(yīng)當(dāng)設(shè)置在合理的位置，符合防火防爆要求。Filling and loading stations, supply stations and pressure regulating stations for inflammable and explosive gas and liquid shall be set up in an appropriate location and

16、shall conform to the requirements on prevention of fire and explosion. 原有的生產(chǎn)、儲存和裝卸易燃易爆危險物品的工廠、倉庫和專用車站、調(diào)壓站，不符合前款規(guī)定的，有關(guān)單位應(yīng)當(dāng)采取措施，限期加以解決。For existing factories and warehouses and specialized depots and wharves for production, storage, loading and unloading of inflammable and explosive dangerous goods, a

17、nd filling and loading stations, supply stations and pressure regulating stations for inflammable and explosive gas and liquid, in case they do not conform to the regulations of this article, relevant units shall adopt measures to give a solution within a time limit. 第十條 按照國家工程建筑消防技術(shù)標(biāo)準(zhǔn)需要進(jìn)行消防設(shè)計的建筑工程、

18、設(shè)計單位應(yīng)當(dāng)按照國家工程建筑消防技術(shù)標(biāo)準(zhǔn)進(jìn)行設(shè)計，建設(shè)單位應(yīng)當(dāng)建筑單位的消防設(shè)計圖紙及有關(guān)資料報送公安消防機(jī)關(guān)審核；Article 10 For construction project conducting fire control design in accordance with requirements of the State Technical Standards on Fire Control for Engineering Construction, the design unit shall conduct the design in accordance with requ

19、irements of the State Technical Standards on Fire Control for Engineering Construction; the construction unit shall submit the drawings of fire control design for the construction project and relevant materials to relevant public security fire control institution for review and approval; 未經(jīng)審核或者經(jīng)審核不合

20、格的，建設(shè)行政主管部門不得發(fā)給施工許可證，建設(shè)單位不得施工。for project not going through review and approval formalities or considered unqualified after the review and examination, the competent construction administrative department shall not issue the license for construction and the construction unit shall not carry out the

21、construction. 經(jīng)公安消防機(jī)構(gòu)審核的建筑工程消防設(shè)施需要變更的，應(yīng)當(dāng)報經(jīng)原審核的公安消防機(jī)構(gòu)核準(zhǔn)；未經(jīng)核準(zhǔn)的，任何單位、個人不得變更。For fire control design for construction project approved by relevant public security fire control institution, in case the design needs changes, it shall be submitted to the previous public security fire control institution gr

22、anting the approval for examination and approval; without approval, no unit or individual shall be allowed to make the changes. 按照國家工程建筑消防技術(shù)標(biāo)準(zhǔn)進(jìn)行消防設(shè)計的建筑工程竣工時，必須經(jīng)公安消防機(jī)構(gòu)進(jìn)行消防驗收；未經(jīng)驗收或者經(jīng)驗收不合格的，不得投入使用。Upon the completion of a construction project containing a fire control design conducted in accordance wit

23、h requirements of the State Technical Standards on Fire Control for Engineering Construction, the project must go through acceptance checked on fire control by relevant public security fire control institutions; project without going through the acceptance check or considered unqualified after the a

24、cceptance check shall not be put into use. 第十一條 建筑構(gòu)件和建筑材料的防火性能必須符合國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)。Article 11 The fire proof performance of constructional elements and construction materials must conform to the state standards or industrial standards. 公共場所室內(nèi)裝修、裝飾根據(jù)國家工程建筑消防技術(shù)標(biāo)準(zhǔn)的規(guī)定，應(yīng)當(dāng)使用不燃、難燃材料的，必須選用依照產(chǎn)品質(zhì)量法的規(guī)定確定的檢驗機(jī)構(gòu)檢驗合格的材料

25、。The indoor fittings and decoration of public places using inflammable and flame retardant materials in accordance with requirements of the State Technical Standards on Fire Control for Engineering Construction, shall choose materials passing qualification check by inspection institution designated

26、in accordance with regulations of the Product Quality Law. 第十二條 歌舞廳、影劇院、賓館、飯店、商場、集貿(mào)市場等公眾聚集的場所，在使用或者開業(yè)前，應(yīng)當(dāng)向當(dāng)?shù)毓蚕罊C(jī)構(gòu)申報，經(jīng)消防安全檢查合格后，方可使用或者開業(yè)。Article 12 Song and dance hall, cinema, hotel, restaurant, commercial center and market fair where the public gather, before putting into use or starting business,

27、 shall be reported to local public security fire control institutions and can only be put into use or start business after passing the acceptance check on fire control safety. 第十三條 舉辦大型集會、焰火晚會、燈會等群眾性活動，具有火災(zāi)危險的，主辦單位應(yīng)當(dāng)制定滅火和應(yīng)急疏散預(yù)案，落實消防安全措施，并向公安消防機(jī)構(gòu)申報，經(jīng)公安消防機(jī)構(gòu)對活動現(xiàn)場進(jìn)行消防安全檢查合格后，方可舉辦。Article 13 For mass act

28、ivities with fire danger, such as large gatherings, fireworks evening party and lantern party, the host unit shall formulate preproposal on fire fighting and emergency evacuation and put into effect relevant fire control security measures, and report to public security fire control institutions whic

29、h will conduct fire control security check. The activities can only be held when qualification check is granted. 第十四條 機(jī)關(guān)、團(tuán)體、企業(yè)、事業(yè)單位應(yīng)當(dāng)履行下列消防安全職責(zé)：Article 14 State organs, organizations, enterprises and institutions shall perform the following duties on fire control security: （一）制定消防安全制度、消防安全操作規(guī)程；(I) F

30、ormulate fire control safety system and operation rules on fire control safety; （二）實行防火安全責(zé)任制，確定本單位和各所屬部門、崗位的消防安全責(zé)任人；(II) Exercise fire prevention safety responsibility system, appoint person-in-charge for fire control safety of the unit and various departments and posts under the unit; （三）針對本單位的特點對職

31、工進(jìn)行消防宣傳教育；(III) Conduct fire control propaganda and education on employees in light of the characteristics of the unit, （四）組織防火檢查，及時消除火災(zāi)隱患；(IV) Organize fire prevention inspection and remove hidden danger in time; （五）按照國家有關(guān)規(guī)定配置消防設(shè)施和器材，設(shè)置消防安全標(biāo)志，并定期組織檢驗、維修，確保消防設(shè)施和器材完好、有效；(V) Allocate and purchase fire

32、 control facilities and devices, set up fire control safety marks in accordance with relevant state regulations, and organize regular inspection and maintenance to ensure a perfect and effective condition of fire control facilities and device; （六）保障疏散通道、安全出口暢通，并設(shè)置符合國家規(guī)定的消防安全疏散標(biāo)志；(VI) Ensure that eva

33、cuation passageway and safety exit are unblocked and set up evacuation marks on fire control safety conforming to the state regulations. 居民住宅區(qū)的管理單位，應(yīng)當(dāng)依照前款有關(guān)規(guī)定，履行消防安全職責(zé)，做好住宅區(qū)的消防安全工作。The administrative unit of residential areas shall perform duties and responsibilities on fire control safety in accord

34、ance with regulations of this article and do a good job on fire control safety in the residential areas. 第十五條 在設(shè)有車間或者倉庫的建筑物內(nèi)，不得設(shè)置員工集體宿舍。Article 15 Rooms within the same building of workshop or warehouse shall not be used as dormitory. 在設(shè)有車間或者倉庫的建筑物內(nèi)，已經(jīng)設(shè)置員工集體宿舍的，應(yīng)當(dāng)限期加以解決。In case rooms in a building w

35、ith workshop or warehouse have already been used as dormitory, the problem shall be solved within a time limit. 對于暫時確有困難的，應(yīng)當(dāng)采取必要的消防安全措施，經(jīng)公安消防機(jī)構(gòu)批準(zhǔn)后，可以繼續(xù)使用。Those who indeed have difficulties for the time being, shall take necessary fire control safety measures and can only continue to use the dormitor

36、y after acquiring approval from public security fire control institutions. 第十六條 縣級以上地方人民政府公安機(jī)關(guān)消防機(jī)構(gòu)應(yīng)當(dāng)將發(fā)生火災(zāi)可能性較大以及一旦發(fā)生火災(zāi)可能造成人身重大傷亡或者財產(chǎn)重大損失的單位，確定為本行政區(qū)域內(nèi)的消防重點單位，報本級人民政府備案。Article 16 For units with higher risk of fire disaster and units that may cause major casualties and deaths or heavy loss of assets i

37、n case of fire disaster, the public security fire control institutions of local people's governments above county level shall select these units as key units on fire control safety of their administrative region and file with the people's government of the same level for reference. 消防安全重點單位除

38、應(yīng)當(dāng)履行本法第十四條規(guī)定的職責(zé)外，還應(yīng)當(dāng)履行下列消防安全職責(zé)：Key units on fire control safety shall, in addition to performing the duties and responsibilities as stipulated in Article 14 of this law, perform the following duties and responsibilities on fire control safety: （一）建立防火檔案，確定消防安全重點部位，設(shè)置防火標(biāo)志，實行嚴(yán)格管理；(I) Set up file syste

39、m on fire prevention, locate critical parts for fire control safety, set up fire prevention marks and exercise strict administration; （二）實行每日防火巡查，并建立巡查記錄；(II) Exercise daily fire prevention patrol and set up patrol record; （三）對職工進(jìn)行消防安全培訓(xùn)；(III) Conduct fire control safety training on employees; （四）制定

40、滅火和應(yīng)急疏散預(yù)案，定期組織消防演練。(IV) Formulate pre-proposal on fire fighting and emergency evacuation and organize regular fire drill. 第十七條 生產(chǎn)、儲存、運輸、銷售或者使用、銷毀易燃易爆危險物品的單位、個人，必須執(zhí)行國家有關(guān)消防安全的規(guī)定。Article 17 Any unit and individual engaged in production, storage, transportation, sales or use and destroy of inflammable a

41、nd explosive dangerous goods, must execute relevant state regulations on fire control safety. 生產(chǎn)易燃易爆危險物品的單位，對產(chǎn)品應(yīng)當(dāng)附有燃點、閃點、爆炸極限等數(shù)據(jù)的說明書，并且注明防火防爆注意事項。Units producing inflammable and explosive dangerous goods shall attach instruction book with datas such as the ignition point, flash point and explosion l

42、imit of the product, and give points of attention for fire and explosion prevention. 對獨立包裝的易燃易爆危險物品應(yīng)當(dāng)貼附危險品標(biāo)簽。Inflammable and explosive dangerous goods with independent packing shall be attached with a tag of dangerous goods. 進(jìn)入生產(chǎn)、儲存易燃易爆危險物品的場所，必須執(zhí)行國家有關(guān)消防安全的規(guī)定。Those who enter places where inflammable

43、 and explosive dangerous goods are produced and stored, must execute the state regulations on fire control safety. 禁止攜帶火種進(jìn)入生產(chǎn)、儲存易燃易爆危險物品的場所。It is prohibited to carry kindling into places where inflammable and explosive dangerous goods are produced and stored. 禁止非法攜帶易燃易爆危險物品進(jìn)入公共場所或者乘坐公共交通工具。It is pro
