18、per the lowest wage.4.3 甲方的發(fā)薪日期為每月日。 party a shall pay the wage on the day every month.五、勞動保護(hù)與勞動條件article five labor protection and labor conditions5.1 甲方須對乙方進(jìn)行勞動平安、業(yè)務(wù)技術(shù)及勞動紀(jì)律等方面的教 育和培訓(xùn),并根據(jù)國家對勞動保護(hù)、平安生產(chǎn)的要求,為乙方提供 必要的生產(chǎn)工作條件,保障乙方的平安健康。party a shall give party b education and training programs relating to
19、 labor safety,professional skills and labor disciplines etc. according to the requirements of state labor protection and safe-production, party a shall provide necessary working condition to ensure party b ' s safety andhealth.六、社會保險和福利article six social insurance and welfare6.1 甲方依法替乙方辦理各項(xiàng)社會保險并
20、繳納保險費(fèi)用。但依法規(guī) 定之分?jǐn)偙壤?,屬于乙方須自行?fù)擔(dān)之各項(xiàng)社會保險金,由甲方于 每月發(fā)薪時,從乙方薪資中代扣代繳。party a shall transact social insurance and pay them for party b. party a shall withhold the social security contribution legally undertook by party b when paying the remuneration every month.6.2 乙方享有國家規(guī)定的所有法定假日。party b will take all statuto
21、ry holidays stipulated by the state.6.3 甲方實(shí)行年休假制度,乙方連續(xù)工作滿一年以上的可享受有薪年 假,申請享受方法按甲方制 定的年假規(guī)定執(zhí)行。party a carries out annual vocation system, party b can take paid annual vocation after continuously working for 1 year and the applying procedure for annual vocation shall be done pursuant to party a' s s
22、tipulation.七、乙方責(zé)任article seven party b ' s responsibility7.1 乙方必須認(rèn)真工作和勞動,保質(zhì)保量地完成自己的生產(chǎn)任務(wù)。party b must work earnestly and accomplish its own taskswith quality and quantity.7.2 乙方必須如實(shí)匯報工作,積極配合和協(xié)助上級的工作。party b must report its job according to the facts and shall cooperate with its uppers and assist
23、their jobs.7.3 乙方應(yīng)嚴(yán)格履行甲方依法制定的規(guī)章制度和?職工手冊?。party b shall strictly implement the rules and regulations and handbook legally stipulated by party a.7.4 乙方應(yīng)保護(hù)甲方的財物,對由于本人責(zé)任造成的直接經(jīng)濟(jì)損失, 必須予以賠償并接受甲方的處分。party b shall take good care of party a' s property and he/shemust indemnify direct damage due to his/her
24、 liability and accepts party a ' s punishment.7.5 乙方在勞動合同有效期內(nèi)未經(jīng)甲方事先書面同意,不得為另一 家雇主工作。party b can not work for another employer without party a written consent in the duration of labor contract.7.6 乙方應(yīng)嚴(yán)格保守甲方的商業(yè)秘密,不得向任何第三方泄露。par ty b shall strictly keep party a' s trade secret and can notdivulg
25、e to any third party7.7 如實(shí)陳述履歷和學(xué)歷。party b shall state his/her curriculum vitae and educational background according to the facts.7.8 如甲方委派乙方培訓(xùn)包括海外培訓(xùn),乙方必須遵守甲方的 培訓(xùn)條規(guī)和承諾。party b shall observe party a' s training rules and undertakingwhen party a assigns party b to be trained.八、甲方無償解除合同article eight
26、 cancellation of the contract without compensationby party a 假設(shè)符合以下情況之一的,甲方可以隨時解除合同,而 不必給予乙方任何經(jīng)濟(jì)補(bǔ)償:party a may cancel the contract at any time withoutcompensation to party b under the following circumstances:8.1 當(dāng)乙方在試用期內(nèi)不符合甲方的職工錄用條件,甲方無須給予 乙方解除的原因。when party b is proven to be unqualified for party a
27、' semployment conditions during probation period, party a need not give party b the reason for cancellation.8.2 乙方嚴(yán)重違反甲方依法制定的規(guī)章制度和勞動紀(jì)律。party b seriously violates rules and regulations, labor discipline legally stipulatedby party a.8.3 乙方嚴(yán)重失職,營私舞弊,給甲方利益造成重大損失。party b seriously neglects his/her du
28、ty and grafts resulting inparty a ' s great loss.8.4 乙方違反中國法律,受到司法處分或追究刑事責(zé)任。party b violates the laws of prc and gains judicial punishment or is found a guilty.九、甲方有償解除合同article night cancellation of the contract with compensation by party a有以下情形之一的,甲方可以解除勞動合同,但是應(yīng)當(dāng)提前 30 天以 書面形式通知乙方或支付一個月根本工資代替,并
29、依法支付乙方經(jīng) 濟(jì)補(bǔ)償金或補(bǔ)助費(fèi)。under the following circumstances, party a may cancel the contract with 30 days prior written notice to party b or paying one month basic wage instead and legally pay economic compensation or subsidy to party b.9.1 乙方患病或非因工受傷,醫(yī)療期滿后仍不能從事原工作或由甲 方另行安排的工作的。 party b is ill or non-work-re
30、lated injured, and unable to do the former job or other job assigned by party a after medical treatment.9.2 乙方不能勝任工作,經(jīng)過培訓(xùn)或調(diào)整工作崗位,仍不能勝任的。party b is not competent for the job and still remains so after training or adjustmentof the post.9.3 本合同訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無 法履行,甲乙雙方不能就變更本合同達(dá)成協(xié)議的the basis for
31、 the conclusion of the contract has greatly changed so that the contract can no longer be carried out, while both parties can not reach an agreement on modifying the contract by mutual negotiation.9.4 甲方瀕臨破產(chǎn),進(jìn)入法定整頓期間或者生產(chǎn)經(jīng)營狀況發(fā)生嚴(yán)重困 難,到達(dá)當(dāng)?shù)厝嗣裾?guī)定的嚴(yán)重困難企 業(yè)標(biāo)準(zhǔn),確須裁減人員,并按法定程序解除勞動合同 的。party a is close to bankr
32、uptcy and enters into legal rectification period or it is in a severe difficulty to meet the standard of severe difficult enterprise stipulated by the local government and the retrenchment is needed, and then party a cancels the contract according to legal procedure.十、 乙方要求解除合同article ten cancellati
33、on of the contract at party b' s request10.1 乙方要求解除勞動合同,應(yīng)當(dāng)提前三十天以書面形式通知甲方, 但必須依照 11.2 條款賠償甲方。party b shall give 30days prior written notice to party a when requesting to cancel the contract, but he/she shall indemnify party a according to article 11.2. 10.2 乙方在以下情況下,可隨時 通知甲方解除勞動合同。under the follo

43、on-toxic working environment, necessary safety measures to guarantee safe working conditions of party b, according to national safety and sanitation standards. party a shall provide special protection measures for female and underage employees according to the labor law.3.4 甲方認(rèn)為乙方的健康狀況將會對工作或其他職工造成不利
44、影響 時,甲方有權(quán)按制度采取相應(yīng)的措施,并有權(quán)要求乙方進(jìn)行健康檢 查,乙方不應(yīng)拒絕。if party a thinks party bs healthiness will effect to the work orother staffs, party a will have the authority to correspond and will have the authority to ask party b to have a physical checkup, at same time the party b should not to refuse.3.5 乙方在被聘用期間,甲方負(fù)

46、titude for raising his/her work efficiency.第 4 條 勞動報酬 payroll4.1 公司實(shí)行內(nèi)部薪酬管理制度,甲方依據(jù)按勞取酬準(zhǔn)那么、企業(yè)經(jīng) 營狀況及崗位確定乙方的薪酬標(biāo)準(zhǔn),并按有關(guān)規(guī)定支付。party a implements company ' s internal salary system. party a will pay party b monthly salary based on the following conditions: the actual business situation, the level of par
47、ty b ' sposition and the general principle of“ distribution according towork .4.2 公司在實(shí)行新工資制度、調(diào)整職工工資水準(zhǔn)或當(dāng)乙方崗位職務(wù) 發(fā)生變化時,甲方可根據(jù)政策給予乙方以工資待遇調(diào)整。party a has the right to adjust the salary standard of party b if party a implements new salary system, or transfers the position of party b.4.3 每月最后一天為甲方的當(dāng)月薪金發(fā)放
48、日。salary will be given to party b on the end of month.第 5 條 社會保障和福利待遇 social insurance fringe benefits5.1 在勞動合同期內(nèi)甲方按照中國政府有關(guān)規(guī)定為乙方辦理養(yǎng)老保 險、醫(yī)療保險、住房公積金、失業(yè)保險等手續(xù)。party a should provide the pension, medical insurance, unemployment insurance and housing fund for party b within the contract period according t
49、o the relevant government laws.5.2 甲方為乙方提供因傷病、工傷、職業(yè)病及方案生育而發(fā)生醫(yī)療 費(fèi)用保險,并創(chuàng)造條件辦好職工福利。5.3 乙方在甲方工作期間不滿一年的可享受累計(jì)3 個月的停工醫(yī)療期,工作時間每增加一年,累計(jì)停工醫(yī)療期增加一個月,最多不超 過 24 個月。party b has the right to have 3 months work-off medical treatment if he/she works for party a less than one year. one more month work-off medical trea
50、tment will be permitted with the one more year employment. the total work-off medical treatment is limited within 24 hours.5.4 乙方享有國家規(guī)定的法定節(jié)假日、婚喪、探親、生育假以及年 休假等有薪假期。party b has the right to enjoy public holidays, marriage leave, funeral leave, home-visit leave, family planning leave, new-year holiday,
51、 company holidays, etc.5.5 乙方因工作或非因工死亡的待遇等按中國政府的法規(guī)執(zhí)行。party b ' s compensation for the death of working accident etc. is executed according to the prevailing rules and regulations enacted by the government.第 6 條 勞動紀(jì)律和獎懲方法 labor discipline and reward6.1 乙方在合同期內(nèi)必須嚴(yán)格遵守國家法律法規(guī),熟知并遵守本公 司?職工手冊?和各項(xiàng)規(guī)章制度。p

53、ration, production and development of company' sbusiness. party a will disciplinary the employees who breach company' s employees handbook.第 7條 合同變更、續(xù)訂、終止和解除 contract renew and termination7.1 合同雙方在履行本合同過程中確因客觀情況發(fā)生重大變化,可 變更本合同的有關(guān)內(nèi)容,但需雙方協(xié)商并辦理變更手續(xù)。both parties have the right to change the contr
54、acts due to not be estimated external conditions during the actual contract process with necessary negotiation and procedures.107.2 本合同期滿即行終止,甲乙雙方如需延長勞動合同期限,應(yīng)在 合同期滿前 30 天,續(xù)訂延長合同期手續(xù)。乙方在本企業(yè)工作滿 年以上,如甲乙雙方同意續(xù)延勞動合同,可以簽訂無固定期限的勞 動合同。the expiration date of signed contract will be considered as the natural te

57、.7.4.1 在試用期內(nèi),甲方認(rèn)為乙方不符合錄用條件包括但不限于 乙方提供的個人情況不實(shí),乙方的試用表現(xiàn)不符合甲方要求等項(xiàng)情 況;party b doesn ' t prove to be suitable through the period of probationary period. 58、nary.)7.4.2 乙方嚴(yán)重違反勞動紀(jì)律或甲方規(guī)章制度,以及公司?職工手 冊?規(guī)定可以辭退的; party b acts in any way that is in serious violation of general labor discipline or violation of other regulations, or violation of handbook.7.4.3 乙方被依法追究刑事責(zé)任或被勞動教養(yǎng)的;party b breaks state law, and has been sentenced to punishment or forced labor.7.4.4 嚴(yán)重失職、營私舞弊,對甲方利益造成重大損害的。party b is in serious neglect of duty, or
