INTRODUCTION

1.于2022年1月1日生效的經(jīng)修訂的MARPOL附則V,除非附則明確許

可,禁止將任I可種類的垃圾排放入海。

TherevisedMARPOLAnnexVwithanentryintoforcedateof1January2022,

prohibitsthedischargeofalltypesofgarbageintotheseaunlessexplicitly

permittedundertheAnnex.

2.MARPOL附則V規(guī)定，除了MARPOL附則V第3、4、5和6條的特殊許

可外，禁止排放一切垃圾。MARPOL附則V推翻了歷史上按垃圾性質(zhì)來認(rèn)

定哪些垃圾可以排放入海的規(guī)定方式以及距岸距離的定義。第7條規(guī)定了應(yīng)

急和非正常情況下的例外情況。原則上排放限于食品廢棄物、標(biāo)明的貨物殘

余、動(dòng)物尸體以及洗滌水中包含的標(biāo)明的對環(huán)境無害的清潔劑、添加劑和貨

物殘存。建議船舶使用港口接收設(shè)施作為排方蜥有垃圾的首選方式。

UndertherevisedMARPOLAnnexV,dischargeofallgarbageisnowprohibited,

exceptasspecificallypermittedinregulations3,4,5and6ofMARPOLAnnexV.

MARPOLAnnexVreversesthehistoricalpresumptionthatgarbagemaybe

dischargedintotheseabasedonthenatureofthegarbageanddefineddistances

fromshore.Regulation7provideslimitedexceptionstotheseregulationsin

emergencyandnon-routinesituations.Generally,dischargeisrestrictedtofood

wastes,identifiedcargoresidues,animalcarcasses,andidentifiedcleaningagents

andadditivesandcargoresiduesentrainedinwashwaterwhicharenotharmfulto

themarineenvironment.Itisrecommendedthatshipsuseportreceptionfacilities

astheprimarymeansofdischargeforallgarbage.

3.100總噸及以上的船舶和核準(zhǔn)載運(yùn)15名或者以上人員的船舶以及固定或

者浮動(dòng)平臺(tái)，均應(yīng)備有1份垃圾管理計(jì)劃。

4.本計(jì)劃的主要目標(biāo)是匡助船東、船舶經(jīng)營人、船員遵循載于附則V中的要

求和有關(guān)國內(nèi)法規(guī)。

5.本計(jì)劃根據(jù)國際海事組織制定的《經(jīng)1978年議定書修訂的1973年國際防

止船舶造成污染公約》(以下簡稱MARPOL73/78公約)經(jīng)修訂的附則V第

10條的要求和我國有關(guān)規(guī)定編寫的。

ThisplaniswritteninaccordancewiththerequirementsRegulation10of

6.本計(jì)劃包括了國際海事組織制定的“2022年垃圾管理計(jì)劃編制指南”所要

求的全部資料和操作程序。并參考了其它利于船上垃圾處理的技術(shù)指南如：

ISO21070“船上垃圾管理和處理標(biāo)準(zhǔn),

7.本計(jì)劃是為本船船員在船上使用，以船員使用的工作語言和英文編寫。

8.本船船員應(yīng)嚴(yán)格按照本“計(jì)劃”的規(guī)定有效地管理垃圾，防止水域污染。

第一章《垃圾管理計(jì)劃》實(shí)施人員職責(zé)

1總負(fù)責(zé)人職責(zé)

本船《垃圾管理計(jì)劃》實(shí)施總負(fù)責(zé)人是本船船長，其主要職責(zé)是：

(1).負(fù)責(zé)垃圾管理計(jì)劃在船上的全面貫徹實(shí)施；

overallimplementationoftheplanonboard.

(2).負(fù)責(zé)組織全體船員的培訓(xùn)、教育工作；

trainingandeducationforthecrew;

(3).船舶發(fā)生垃圾污染事故時(shí)，組織船員進(jìn)行應(yīng)急處理并及時(shí)報(bào)告主管機(jī)

關(guān)。

公告標(biāo)牌、垃圾管理計(jì)劃和垃圾記錄保存

Placards.Garbagemanagementplansandgarbagerecording-keeping

(1)(a)總長度為12m或者以上的船舶和固定或者浮動(dòng)平臺(tái)均應(yīng)張貼告示

以使船員和乘客知曉本附則第3、4、5和6條中合用的排放要求。

(2)所有100總噸及以上的船舶和核準(zhǔn)載運(yùn)15名或者以上人員的船舶以及

固定或者浮動(dòng)平臺(tái)，均應(yīng)備有一份船員必須遵守的垃圾管理計(jì)劃。該計(jì)戈J

應(yīng)就減少、采集、儲(chǔ)藏、力口工和姐里垃圾以及船上設(shè)備使用等提供書面程序,

還應(yīng)指定負(fù)責(zé)執(zhí)行該計(jì)劃的人員。該計(jì)劃應(yīng)基于本組織制定的指南，并用

船員的工作語言書寫。

(a)每次排放入?；蛘咧两邮赵O(shè)備或者完成的焚燒作業(yè)都應(yīng)即將記錄在《垃

圾記錄簿》中，并在焚燒或者封瞅的當(dāng)天由負(fù)責(zé)的高級(jí)船員簽字?！独?/p>

錄簿》每記完一頁都應(yīng)日船長簽字?！独涗洸尽返拿宽?xiàng)記載應(yīng)至少用

英文、法文或者西班牙文書寫。如果這些記載也使用該船船旗國的官方語

言書寫，在發(fā)生爭執(zhí)或者有不允許見時(shí)，以船旗國的官方語言的記載為準(zhǔn)。

ship.TheentriesintheGarbageRecordBookshallbeatleastinEnglish,French

orSpanish.

WheretheentriesarealsomadeinanofficiallanguageoftheStatewhoseflag

theshipisentitledtofly,theentriesinthatlanguageshallprevailincaseofa

disputeordiscrepancy.

(b)每次排放或者焚燒的記錄都應(yīng)寫明曰期與時(shí)間、船舶位置、垃圾種類和焚

燒或者排放垃圾的估計(jì)數(shù)量；

日期起保存2年；

(d)如發(fā)生本附則第7條所指的任何排放或者意外落失，垃圾記錄簿上應(yīng)予

以記錄,或者對任何小于400總噸的船舶，應(yīng)在該船的正式航海日志中記

錄該排放或者落失的地點(diǎn)、情況和原因、排放或者落失的物品細(xì)目、以及

為防止或者盡量減少這種排放或者意外落失業(yè)已采取的合理預(yù)防措施。

Intheeventofanydischargeoraccidentallossreferredtoinregulation7ofthis

AnnexanentryshallbemadeintheGarbageRecordBook,orinthecaseofany

shipoflessthan400grosstonnage,anentryshallbemadeintheship'sofficial

log-book,ofthelocation,circumstancesof,andthereasonsforthedischargeor

loss,detailsoftheitemsdischargedorlost,andthereasonableprecautionstaken

topreventorminimizesuchdischargeoraccidentalloss.

⑷主管機(jī)關(guān)可以對下述船舶免除《垃圾記錄簿》要求

(i)核準(zhǔn)載運(yùn)15名或者以上人員，航行持續(xù)時(shí)間為1h或者以下的船舶;或

者Anyshipengagedonvoyagesofone(1)hourorlessinduration

whichiscertifiedtocarry15personsormore;or

(ii)從事海床勘探與開辟的固定或者浮動(dòng)的平臺(tái)。

fixedorfloatingplatformswhileengagedinexplorationandexploitationofthe

sea-bed.

⑸本公約締約國政府的主管機(jī)關(guān)，可檢查停靠其港口或者近海裝卸站的合

用本規(guī)定的任何船舶的《垃圾記錄簿》或者船舶的正式航海日志，并可將

記錄簿或者日志中的任何記錄制成副本并要求船長證明該副本是該項(xiàng)記錄

的真實(shí)副本。這種經(jīng)船長證明為船上《垃圾記錄簿》或者船舶的正式航

海日志中某項(xiàng)記錄的真正的副本在件可法律訴訟中應(yīng)作為該項(xiàng)記錄中所述事

實(shí)的證據(jù)。主管機(jī)關(guān)根據(jù)本項(xiàng)規(guī)定對《垃圾記錄簿》或者船舶的正式航海

日志的檢查和制作確證無誤的副本應(yīng)盡速進(jìn)行，并不應(yīng)對船舶造成不當(dāng)?shù)?/p>

延誤。ThecompetentauthorityoftheGovernmentofaPartyto

theConventionmayinspectthegarbagerecordbookorship'sofficiallog-book

onboardanyshiptowhichthisregulationapplieswhiletheshipisinitsportsor

offshoreterminalsandmaymakeacopyofanyentryinthosebooks,andmay

requirethemasteroftheshiptocertifythatthecopyisatruecopyofsuch

anentry.Anycopysomade,whichhasbeencertifiedbythemasteroftheshp

asatruecopyofanentryintheship'sgarbagerecordbookorship's

officiallog-book,shallbeadmissibleinanyjudicialproceedingsasevidenceof

thefactsstatedintheentry.Theinspectionofagarbagerecordbookorship's

officiallog-bookandthetakingofacertifiedcopybythecompetentauthority

underthisparagraphshallbe

performedasexpeditiouslyaspossiblewithoutcausingtheshiptobeunduly

delayed.

(6)如第7.1.3和第7.1.3條中所述的魚具的意外落失或者排放會(huì)對海洋環(huán)境

或者航行造成嚴(yán)重威脅，應(yīng)向船舶的船旗國報(bào)告，如果落失或者排放發(fā)生

在某一沿海國家管轄權(quán)范圍內(nèi)的水域，也應(yīng)向該沿海國家報(bào)告。

第三章船舶垃圾及防污染

ChapterIIIPREVENTIONOFPOLLUTIONFROMGARBAGE

1.為了確保經(jīng)濟(jì)效益和環(huán)境保護(hù)，船舶垃圾管理人員應(yīng)合理調(diào)節(jié)以下工作

2.當(dāng)船舶提出供應(yīng)備件/伙食時(shí)，航運(yùn)公司應(yīng)在早期階段鼓勵(lì)供應(yīng)商去除、

減少包裝,限制產(chǎn)生船舲垃圾。

Whenrequisitioningstoresandprovisions,shippingcompaniesshouldencourage

theirsupplierstoremove,reduce,allpackaging,atanearlystage,tolimitthe

generationofgarbageonboardships.

3.船上的垃圾種類，部份根據(jù)MARPOL73/78附則V規(guī)定進(jìn)行分類。但有些

可根據(jù)地區(qū)、國家或者地方，另分類，如：生活、航行、貨物、食品、檢修

方面所產(chǎn)生的垃圾。

船舶的垃圾按MARPOL73/78附則V第10條的規(guī)定,下方第4,1段將垃圾分

成9大類。

4.3垃圾數(shù)量

Amountofgarbage

船上的垃圾數(shù)量應(yīng)以立方米估算，如有可能應(yīng)按類別分別估算。垃圾記錄簿

中含有垃圾估算量的許多參考數(shù)據(jù)。認(rèn)識(shí)到垃圾數(shù)量估算的精確度還需詮

釋。垃圾加工處理先后的體積估算會(huì)有所不同，有些加工處理程序可能無法

對體積進(jìn)行實(shí)用的估算，比如持續(xù)的食品廢棄物處理，因此在填寫記錄和詮

釋記錄時(shí)應(yīng)考慮到這些因素。

4.4i|婦居Receipts

船長必須從港口垃圾接收設(shè)施操作人員或者從接收船舶的船長處得到一份具

體說明所轉(zhuǎn)移的垃圾估計(jì)量的收據(jù)或者證明。該嵋或者證明須與《垃圾記錄

簿》一起在船上保存2年。

5.船舶垃圾管理原則及減少垃圾的措施

Theprincipalofgarbagemanagementandthemeasurestakentoreducegarbage

⑴MARPOL附則V第3條規(guī)定禁止將垃圾排放入海。在滿足一定的條件下，

允許將食品廢棄物、動(dòng)物尸體、貨艙、甲板和外部洗滌水中包含的清潔劑和

添加劑和被認(rèn)定為對海洋環(huán)境無害的貨物殘存排放入海。

些便利器具應(yīng)受到限制，并在可能的情況下代之以洗后可再用的物具。

第五章垃圾采集程序

1船舶垃圾的采集、分類及采集容器

Suitablereceptaclesforcollectionandseparation

為了采集和分類，船上在餐廳、廚房、洗手間、盥洗室、船員生活區(qū)走廊、

機(jī)艙、和甲板等處所設(shè)置了適當(dāng)?shù)挠忻黠@標(biāo)志的采集容器。

⑴“紅色”標(biāo)記的容器用于采集塑料和混有塑料制品的垃圾；

2.垃圾的來源和采集

(1)塑料制品(含塑料袋)：餐廳、廚房、歇息室、臥室及船舶備件的包裝材

料為來源，各部門管理人員分類采集；

(4)有關(guān)貨物的垃圾：裝貨時(shí)的墊艙物料、木料、托盤、包裝材料等由甲板

部人員負(fù)責(zé)分類采集；

3.初步采集和分類的處理方法
