2025建筑工程施工合同（中英文對(duì)照版）ConstructionContractforBuildingEngineering2025(Chinese-EnglishVersion)本合同由以下雙方于年月日簽訂：ThisContractisenteredintobyandbetweenthefollowingpartiesonthedateofYearMonthDay:**甲方（發(fā)包方）:**PartyA(Contractor):名稱：地址：法定代表人：聯(lián)系XX：統(tǒng)一社會(huì)信用代碼：Name:Address:LegalRepresentative:ContactTelephone:UnifiedSocialCreditCode:乙方（承包方）:PartyB(Contractee):名稱：地址：法定代表人：聯(lián)系XX：統(tǒng)一社會(huì)信用代碼：Name:Address:LegalRepresentative:ContactTelephone:UnifiedSocialCreditCode:鑒于甲方將位于的建筑工程發(fā)包給乙方施工，為了明確雙方的權(quán)利和義務(wù)，根據(jù)《中華人民共和國(guó)合同法》及相關(guān)法律法規(guī)，雙方本著平等、自愿、公平的原則，經(jīng)友好協(xié)商，達(dá)成如下協(xié)議：WhereasPartyAintendstoengagePartyBtocarryoutabuildingprojectlocatedatandtoclearlydefinetherightsandobligationsofbothparties,basedontheContractLawofthePeople'sRepublicofChinaandrelatedlawsandregulations,PartyAandPartyB,basedontheprincipleofequality,voluntariness,andfairness,haveagreeduponthefollowingtermsafterfriendlyconsultations:第一條工程概況Article1:ProjectOverview工程名稱:ProjectName:工程地點(diǎn):ProjectLocation:工程內(nèi)容:ProjectContent:工程規(guī)模:ProjectScale:總建筑面積：平方米TotalConstructionArea:SquareMeters工程范圍:ScopeofWork:第二條合同工期Article2:ContractDuration計(jì)劃開工日期:PlannedStartDate:年月日YearMonthDay計(jì)劃竣工日期:PlannedCompletionDate:年月日YearMonthDay總工期:TotalDuration:日歷天CalendarDays延期責(zé)任:LiabilityforDelays:由于乙方原因?qū)е鹿て谘诱`，每延誤一天，乙方應(yīng)向甲方支付合同總價(jià)的%作為違約金。AnydelaycausedbyPartyBshallresultinPartyBpayingPartyAapenaltyequalto%ofthetotalcontractpriceforeachdayofdelay.第三條合同價(jià)款A(yù)rticle3:ContractPrice合同總價(jià):TotalContractPrice:人民幣（大寫）：元整RMB(inwords):YuanWhole付款方式:PaymentMethod:（1）工程預(yù)付款：合同總價(jià)的%，于合同簽訂后日內(nèi)支付。AdvancePayment:%ofthetotalcontractprice,tobepaidwithindaysafterthesigningofthisContract.（2）工程進(jìn)度款：按月進(jìn)度支付，每月支付已完工程量的%。ProgressPayment:Paymentsaremademonthly,covering%ofthecompletedworkvolumeforthatmonth.（3）工程竣工款：工程竣工驗(yàn)收合格后日內(nèi)支付合同總價(jià)的%。CompletionPayment:%ofthetotalcontractpriceispaidwithindaysaftertheprojectpassesthefinalinspection.違約金:Penalty:任何一方未按合同約定支付款項(xiàng)的，每逾期一天，應(yīng)向?qū)Ψ街Ц稇?yīng)付金額的%作為違約金。AnypartythatfailstomakepaymentasstipulatedinthisContractshallpaytheotherpartyapenaltyof%oftheamountdueforeachdayofdelay.第四條工程質(zhì)量Article4:QualityoftheProject質(zhì)量標(biāo)準(zhǔn):QualityStandards:本工程執(zhí)行《建筑工程施工質(zhì)量驗(yàn)收統(tǒng)一標(biāo)準(zhǔn)》GB50300-2013及國(guó)家和地方的相關(guān)標(biāo)準(zhǔn)。Thisprojectshallbecarriedoutinaccordancewiththe"UnifiedStandardforQualityAcceptanceofBuildingEngineeringConstruction"GB50300-2013,aswellasrelevantnationalandlocalstandards.質(zhì)量驗(yàn)收:QualityInspection:工程質(zhì)量的驗(yàn)收由甲方組織，乙方配合。驗(yàn)收不合格的，乙方應(yīng)在規(guī)定時(shí)間內(nèi)返工或整改。QualityinspectionshallbeorganizedbyPartyAwiththecooperationofPartyB.Incaseofunsatisfactoryinspection,PartyBshallcarryoutreworkorrectificationwithinthespecifiedtime.質(zhì)量保修:QualityWarranty:工程竣工驗(yàn)收合格后，乙方提供年的質(zhì)量保修期。Aftertheprojectpassesthefinalinspection,PartyBshallprovidea-yearwarrantyfortheproject.第五條安全責(zé)任Article5:SafetyResponsibility安全措施:SafetyMeasures:乙方應(yīng)嚴(yán)格按照安全生產(chǎn)規(guī)定進(jìn)行施工，確保施工人員和設(shè)備的安全。PartyBshallstrictlycomplywithsafetyproductionregulationsandensurethesafetyofworkersandequipment.保險(xiǎn):Insurance:乙方應(yīng)為施工現(xiàn)場(chǎng)的員工和設(shè)備購買必要的保險(xiǎn)。PartyBshallpurchasenecessaryinsuranceforitsstaffandequipmentontheconstructionsite.責(zé)任劃分:LiabilityAllocation:因乙方原因造成的安全事故，由乙方承擔(dān)全部責(zé)任。PartyBshallbearfullresponsibilityforanyaccidentscausedbyitsnegligence.第六條材料與設(shè)備Article6:MaterialsandEquipment材料采購:MaterialProcurement:工程所需材料由乙方負(fù)責(zé)采購，乙方采購的材料必須符合國(guó)家和行業(yè)標(biāo)準(zhǔn)。MaterialsrequiredfortheprojectshallbeprocuredbyPartyB,whichshallensurethatallmaterialscomplywithnationalandindustrystandards.設(shè)備管理:EquipmentManagement:施工期間，乙方應(yīng)妥善管理施工設(shè)備，確保設(shè)備正常運(yùn)行。Duringconstruction,PartyBshallproperlymanageconstructionequipmenttoensureitsnormaloperation.第七條驗(yàn)收與移交Article7:AcceptanceandTransfer驗(yàn)收標(biāo)準(zhǔn):AcceptanceCriteria:工程驗(yàn)收標(biāo)準(zhǔn)以本合同約定的工程質(zhì)量標(biāo)準(zhǔn)為準(zhǔn)。TheacceptancecriteriafortheprojectshallbebasedonthequalitystandardsstipulatedinthisContract.驗(yàn)收程序:AcceptanceProcedures:驗(yàn)收工作由甲方組織，乙方配合，驗(yàn)收合格后雙方簽訂《工程驗(yàn)收合格證明書》。AcceptanceshallbeorganizedbyPartyAwiththecooperationofPartyB,anduponsatisfactorycompletion,bothpartiesshallsignthe"CertificateofProjectAcceptance."工程移交:ProjectTransfer:工程驗(yàn)收合格后日內(nèi)，乙方將工程交付甲方使用。Withindaysaftersuccessfulacceptance,PartyBshalltransfertheprojecttoPartyAforuse.第八條保修責(zé)任Article8:WarrantyLiability保修期限:WarrantyPeriod:本工程保修期為年，自工程竣工驗(yàn)收合格之日起計(jì)算。Thewarrantyperiodforthisprojectisyears,commencingfromthedateofsuccessfulfinalinspection.保修范圍:WarrantyScope:包括但不限于結(jié)構(gòu)工程、防水工程、機(jī)電設(shè)備等。Includingbutnotlimitedtostructuralengineering,waterproofingengineering,andmechanicalandelectricalequipment.保修服務(wù):WarrantyServices:在保修期內(nèi)，乙方應(yīng)及時(shí)響應(yīng)甲方的保修請(qǐng)求。Withinthewarrantyperiod,PartyBshallpromptlyrespondtoPartyA'swarrantyrequests.第九條違約責(zé)任Art
