PLANTCONSTRUCTIONCONTRACT

第一條定義

“業(yè)主”指。

“承包商”指。

“工廠”指在附錄×中指定的構成固定設備的全部機器、設備和材料。

“工地”指按本合同用于建筑工廠的全部地皮。

“工程”指承包商按本合同實施的工程。

“合同價格”指業(yè)主向承包商支付的全部工程款項。

Article1-Definitions

\\\"ThePlant\\\"shallmeanalloranypartofthemachinery,equipmentandmaterialsformingthepermanentinstallationasspecifiedinAppendix(…).

其次條承包商的職責

1.承包商應負責設計、籌劃以及在工地上建筑工廠。

2.除了業(yè)主依據第×條供應的項目和設施，承包商應供應全部為使工廠勝利建筑所必需的設備、材料、工具、設施、勞工和服務。

3.承包商應依據附錄×中的日程支配施工。

4.承包商應依據附錄×中的規(guī)定為業(yè)主培訓工廠設備的操作和修理人員。

5.承包商應向業(yè)主供應附錄×中規(guī)定的備件。

6.承包商應向業(yè)主供應附錄×中指定的修理設備。

Article2-Contractor\\’sResponsibilities

1.TheContractorshalldesign,engineer,andconstructthePlantattheSite.

2.TheContractorshallprovideallequipment,materials,tools,facilities,labourandservicesnecessaryforthesuccessfulconstructionofthePlantexceptthoseitemsandfacilitiestobesuppliedbytheOwnerunderArticle(…).

3.TheContractorshallperformtheWorksinaccordancewiththeScheduleinAppendix(…).

4.TheContractorshallprovidetheOwner\\’spersonnelwithtrainingofoperationandmaintenanceofthePlantinaccordancewithAppendix(…).

5.TheContractorshallsupplytheOwnerwiththesparepartsspecifiedinAppendix(…).

6.TheContractorshallsupplytheOwnerwiththemaintenanceequipmentspecifiedinAppendix(…).

第三條業(yè)主的職責

1.業(yè)主應供應工地，并在本合同有效期內允許承包商自由地、不受干擾地出入該工地。

2.業(yè)主應按時供應附錄×中指定的物件和設施。

3.業(yè)主將從有關部門獵取為工廠建筑、設備運行所必需的執(zhí)照和許可證，包括承包商雇員的工作許可證。

4.業(yè)主應按第×條中規(guī)定的合同價格向承包商支付工程款項。

Article3-Owner\\’sResponsibilities

1.TheOwnershallmakeavailabletheSiteandgranttheContractorfreeanduninterruptedaccesstheretothroughoutthedurationofthisContract.

2.TheOwnershallprovidethoseitemsandfacilitiesspecifiedinAppendix(…)atthetimethereinestablished.

3.TheOwnerwillobtainfromtherelevantAuthoritiesthoselicensesandpermitsnecessarytoconstructandoperatethePlantontheSiteincludingworkpermitfortheContractor\\’semployees.

4.TheOwnershallpaythecontractorfortheWorksperformedtheContractPricesetoutinArticle(…).

第四條合同價格

1.在本合同生效后××天內，業(yè)主應向承包商支付金額為合同價格，作為承包商完成該工程并擔當本合同規(guī)定的全部義務的全部酬勞。

2.合同價格不再上調，完成工種的成本風險應由承包商擔當，商定合同價格時應認為承包商已獲得全部信息并已把全部可能影響成本的因素估量在內。

Article4-ContractPrice

1.Within(…)daysaftertheeffectivedateofthisContract,theOwnershallpaytheContractorasfullandcompletecompensationforaccomplishingtheWorksandassumingallobligationsunderthisContracttheContractPriceintheamountof.

2.TheContractPriceisnotsubjecttoescalation,andthecostofexecutingtheWorksshallbetheriskoftheContractorwhoshallbedeemedtohaveobtainedallinformationandtakenintoaccountallcircumstanceswhichmayaffectthecostinagreeingtheContractPrice.

第五條設計圖樣

1.承包商應依據合同，在附錄××規(guī)定的時間內向業(yè)主提交工廠建筑所需的圖樣，供業(yè)主審批。業(yè)主應在收到這些圖樣后一個月內，對圖樣進行審核，并作出批準或不批準的打算。

2.承包商應對上述圖樣中的任何缺點、錯誤或疏漏負責，除非這種缺點、錯誤或疏漏是因業(yè)主書面供應的不精確?????信息所致。

3.業(yè)主或承包商相互供應的全部圖樣和技術資料，收到方應作為機密文件對待，除非另有商定，收到方不得將這些圖樣和資料用于與本合同無關的其他目的。

Article5-Drawings

1.TheContractorshallsubmittotheOwnerforapprovalandreviewwithinthetimespecifiedinAppendix(…)suchdrawingsasmayberequiredforConstructionofthePlantunderthisContract.WithinonemonthafterreceivingsuchdrawingstheOwnershallreviewandapproveordisapprovethedrawing.
